<br />. <br /> <br />. <br /> <br />May 26, 1993 Plan Commission Meeting Minutes Page 3 <br /> <br />Mr. Marsh asked Mr. Goldman if a surveyor plat of the neighborhood is available that shows <br />the block's prevailing pattern of front building lines. Mr. Goldman submitted a copy of the <br />county locator map for the area, a copy of the city plat sheet of the block and copies of pertinent <br />city housing certificate applications. <br /> <br />Ms. Kreishman stated that she feels the revised plats are greatly improved over those submitted <br />last month because of the change in lot width. These lots were created because a street was <br />abandoned in that area creating several lots that are not in conformity with the rest of the <br />neighborhood. <br /> <br />Ms. Ratner stated that she also feels the new plats are greatly improved. However, she feels <br />that the front building line should be moved back to at least 40' from the front building line. <br />Mr. Kennedy stated that he would agree to a 40' front building line. Ms. Ratner stated that this <br />Commission should not be concerned with prohibiting vehicular access easements between <br />property owners and therefore a ban on access to Greensfelder should not be made part of the <br />plat. <br /> <br />Mr. Safe stated that the application should be approved based upon its satisfaction of all of the <br />restrictions stated in the Zoning Code. He agrees with Ms. Ratner that this is not the proper <br />forum to decide vehicular access to the property. He feels that Mr. Goldman's concern with the <br />spatial relationship to other properties is irrelevant because perceptions of such relationships are <br />too subjective. He further stated that the applicant asked for guidance on revising the plat at the <br />last meeting but the Commission had not given any substantive guidance to the applicant. <br /> <br />Mr. Kahn stated that a term like "substantially conform" calls for a judgement. One of the roles <br />of the Commission is to decide as a group whether or not proposals meet that requirement. <br /> <br />Ms. Kreishman agreed with Ms. Ratner that the front building line is too close to the front <br />property line at 30' and should be moved back to 40'. <br /> <br />Mr. Goldman reemphasized that the lot in question is not a part of the Teasdale Court <br />subdivision. It is Part of Lots 32 and 33 of Central Suburbs, as shown on the plats. The issue <br />of street maintenance should therefore be specifically spelled out in the resubdivision documents <br />to avoid future confusion on the matter. <br /> <br />Ms. Ratner moved that the Plan Commission recommend that the City Council approve the final <br />plat, as presented at tonight's meeting, if the following modifications are made: 1) The front <br />building line be moved to 40' from the front property line; 2) Proof of a deed restriction be <br />included on the plat stating that owners of the lots are responsible for street maintenance; and <br />3) Side building lines on the east side of Lot B and the west side of Lot A be moved to coincide <br />with the side easements as shown on the plat. The motion was seconded by Mr. Kahn and <br />passed by a vote of 6 - 0, with one abstention by Ms. Peniston. <br /> <br />m-5-26.plc <br />
