<br />- <br /> <br />. <br /> <br />. <br /> <br />June 17,1993 Plan Commission Meeting Minutes Page 4 <br /> <br />Mr. Safe stated that he would vote against the designation because he feels that the rights of the <br />property owner to be free from governmental interference outweighs the marginal historic <br />significance of this building's facade. He further stated that the Comprehensive Plan's <br />compatibility in this situation is inconsequential because the plan is vague on the subject. <br /> <br />Mr. Kahn stated that even though he felt the building's historical significance is apparent, he <br />must oppose it, in this special situation, in light of the owner's opposition because it will infringe <br />upon the owner's property rights. <br /> <br />Ms. Ratner reemphasized that the Zoning Code limits the Plan Commission's review of the <br />designation to its compatibility with the Comprehensive Plans. <br /> <br />Mr. Foxworth moved that the Plan Commission recommend that the City Council deny approval <br />of the designation of the Beverly / Fine Arts Theater at 7740 Olive as an historical landmark. <br />The motion was seconded by Mr. Safe and passed by a vote of 4 - 2. <br /> <br />Adj ou rnment <br /> <br />Mr. Safe moved that the Plan Commission meeting be adjourned.
