Hill, Zoning Administrator <br /> <br />RE: <br /> <br />Possible discrepancy in the 1/26/94 Minutes <br /> <br />At the 2/23/94 meeting, Mr. Foxworth stated that portions of the minutes from the 1/26/94 meeting were <br />incorrect concerning the motion and vote on Conditional Use Permit #314. The application was for FTS <br />Delivery at 7426 Olive, from Gordon F. Webb (The CUP hearing in question occurred directly after the <br />rezoning meeting for the same property). Mr. Foxworth stated that he did not second the motion in favor of <br />the conditional use permit and that he voted against recommending approval of the application. <br /> <br />The minutes were not approved because two of the members who were at the 1/26/94 meeting were not at the <br />2/23/94 meeting. <br /> <br />My notes from the meeting indicate that Ms. Kreishman moved that the Plan Commission recommend approval <br />of the Conditional Use Permit contingent on rezoning the property and subject to conditions. The motion was <br />seconded by Mr. Foxworth and passed by a vote of 3 - 1 with one abstention, with Ms. Kreishman, Mr. Kahn, <br />and Mr. Foxworth voting "aye," Mr. Marsh voting "nay" and Mr. Safe abstaining. <br /> <br />If the minutes are incorrect, it could mean that the motion did not pass and the recommendation to the City <br />Council is void. Since the City Council will be voting on the CUP shortly, it is important we resolve this <br />matter as soon as possible. <br /> <br />A draft copy of the minutes concerning the CUP (and the rezoning) are enclosed. Please review the material <br />and indicate in writing your recollection below.
