<br />., <br /> <br />. <br /> <br />. <br /> <br />6-22-94 Plan Commission Meeting Minutes Page 9 <br /> <br />dealing with the refuse container enclosure in the flood way should be dropped from the list. <br /> <br />Mr. Foxworth moved approval of the application based on the fact that the evidence supported <br />a finding that the proposed Conditional Use will meet the standards for approval contained in <br />Zoning Code ~34-65.4; subject to the following conditions: <br /> <br />1. Site work shall not be started and no building permit shall be issued until a development <br />permit is issued by the local administrator of the City Flood Plain Management <br />Ordinance. <br />2. Curb cuts shall be as approved by the State Highway Department. <br />3. Site work shall not be started and no building permit shall be issued without first <br />obtaining the approval ofMSD. Special attention shall be given to storm water discharge <br />and storm water detention shall be provided in accordance with MSD recommendations. <br />4. A detailed landscaping plan shall be submitted to the Director of Planning for his review <br />and approval. Landscaping shall be installed and maintained in accordance with the <br />approved plan. <br />5. Signs shall comply with the University City Sign Code in every respect; and strips of <br />lighting shall not be used to outline architectural element such as edges of roof beams in <br />a manner that is currently used on the existing building. This is to be the ruling of the <br />City Council and is not subject to an appeal to the Board of Adjustment. <br />6. The operator of the restaurant shall regularly police the site and the area adjacent to the <br />restaurant to remove litter and debris. <br />7. Trash containers for patron use shall be available on the premises at all times. <br />8. An exhaust system shall be installed and/or other means shall be taken to prevent any <br />food preparation odors or cooking odors from being perceptible beyond the property line. <br />9. Lighting fixtures for parking lot and driveway shall be shaded to prevent casting direct <br />light on neighboring residential property. <br />10. Hours of operation shall be limited to the hours of 6:00 a.m. to 11:00 p.m. on Sunday <br />through Thursday and 6:00 a.m. through 12:00 midnight on Friday and Saturday. <br />11. All exterior speakers shall have adjustable volume controls and shall be so placed and <br />operated so as to avoid disturbing the quiet of residents in the area. <br /> <br />The motion was seconded by Ms. Peniston and passed by a vote of 4 to O. <br /> <br />Other Business: <br /> <br />Paul Schoomer was introduced as the new Council Liaison.
