<br />'t <br /> <br />- <br /> <br />. <br /> <br />. <br /> <br />PLAN COMMISSION <br />Minutes <br />July 27, 1994 <br /> <br />The Plan Commission held its regular meeting in the E.O.C. room located in the basement at <br />City Hall, 6801 Delmar Boulevard, University City, Missouri on July 27, 1994. The meeting <br />commenced at 7:30 p.m. with Vice Chairperson Ratner presiding. <br /> <br />Voting Members Present <br />Andrea Ratner, Vice Chairperson <br />Charles Foxworth <br />Thomas E. Kahn <br />A. John Solodar <br /> <br />Voting Members Absent <br />Stephen P. Marsh, Chairperson <br />Carl Safe <br />Mickey Peniston <br /> <br />Council Member Present: Paul Schoomer, Council Liaison <br />Staff Present: Al Goldman, Director of Planning; Frank B. Hill, Zoning Administrator <br /> <br />Approval of Minutes <br /> <br />Vice Chairperson Ratner stated that the Commission would now consider approval of the minutes <br />from the June 22, 1994 meeting. Mr. Foxworth moved for approval of the June 22, 1994 <br />minutes. The motion was seconded by Mr. Solodar and passed by a vote of 3 to 0 with one <br />abstention; with Mr. Foxworth, Mr. Kahn and Mr. Solodar voting "aye" and Ms. Ratner <br />abstaining. <br /> <br />Public Hearing: Conditional Use Pennit amendment #307(A) for waiver of condition <br />concerning planting of two freestanding trees, 7740 Olive <br /> <br />Vice Chairperson Ratner announced that a public hearing was scheduled to hear an application <br />from Higher Heights Christian Church represented by Bettye Battle Turner for an amendment <br />to Conditional Use Permit #307 in order to waive the part of condition #2 that requires "at least <br />two freestanding trees shall be planted in tree pits located in the center row of parking" in the <br />parking lot at 7740 Olive. <br /> <br />The Vice Chairperson noted the Commission's procedures and criteria for reviewing conditional <br />use permits and amendments to them. She specifically stated that the Plan Commission must <br />consider whether the use: a) complies with all applicable provisions of the Zoning Code; b) at <br />the specific location will contribute to and promote the community welfare or convenience; c) <br />will not cause substantial injury to the value of neighboring property; d) complies with the <br />overall neighborhood development plan and existing zoning district provisions; and e) will <br />provide, if applicable, off-street parking and loading areas in accordance with the standards <br />contained in the Zoning Code. The Vice Chairperson called upon the applicant. <br /> <br />Bettye Battle Turner, 4236 Lindell, Suite 201, St. Louis, Missouri 63108, attorney for Higher <br />Heights Christian Church, stated that the church is requesting the waiver of the condition <br />because it would cause the church to endure the expense and labor of tearing up the parking lot. <br /> <br /> <br />. <br />
