Mr. Solodar has observed that many of the City's trees planted along Morgan have <br />become distressed due to lack of care. They may not survive. He wants to make sure that <br />somebody is appointed by the church to care for those and the new trees planted by the City. <br />Most new trees need approximately 5 gallons of water each week in order to survive. Further, <br />the Siberian elm still needs to be removed. Ms. Battle Turner stated that Ralph Petty, Assistant <br />Pastor, 862-8003 is the contact person for tree care. Mr. Goldman suggested that Mr. Petty <br />contact Norma Bonham, City Forester as soon as possible concerning tree care and replacement. <br /> <br />7-27-94 Plan COmmission Meeting Minutes Page 3 <br /> <br />Mr. Kahn stated that he was concerned with the higher elevation of phase II of the Car-X <br />expansion. Mr. Foxworth stated that Car-X should have a study of the grade. <br /> <br />Ms. Ratner stated that she agrees with the amendment as proposed by Mr. Goldman but feels <br />that there should be a deadline attached to the amendment. Ms. Battle Turner stated that a <br />deadline is fine as long as it will not interfere with the church finally obtaining a permanent <br />occupancy permit. Mr. Goldman stated that the plantings and clean up should actually be <br />initiated quickly. Mr. Schoomer stated that the City is as anxious as the church to close the file <br />on this conditional use. <br /> <br />The Plan Commission Members decided that September 30, 1994 would be a suitable deadline <br />for the ground cleanup, the removal of the Siberian elms and their replacement with a new tree. <br /> <br />The Plan Commission detennined that the evidence presented to the Plan Commission supports <br />the conclusion that the Proposed conditional use amendment: a) Complies with all applicable <br />provisions of this chapter; b) At the specific location will contribute to and promote the <br />community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighbOring property; d) Complies with the overall neighborhood development plan and existing <br />zoning district provisions; and e) Will provide, if applicable, off-street parking and loading areas <br />in accordance with the standards contained in the Zoning Code. Mr. Solodar moved that the <br />Plan Commission recommend approval of the Conditional Use Permit amendment by changing <br />condition #2 as follows: <br /> <br />2. By September 30, 1994, strnighten up the north edge of the parking lot paving to create <br />a single planting strip approximately 8 feet wide by 142 feet long, removing any paving, <br />gravel or stones from this area. Permit the City to plant trees in this area. By <br />September 30, 1994, remove the Siberian elms at the parking lot entrance at Riegert and <br />at North & South, and replace with a tree on North & South with a 2 inch minimum <br />caliper tree, selecting from a list of suitable trees obtained from the City Forester. Agree <br />to water and maintain the trees planted by the City. <br /> <br /> <br />The motion was seconded by Mr. Kahn and passed by a vote of 4 to 0 with aU members voting <br />"aye.
