.

.

January 25, 1995 Plan Commission Meeting Minutes

Page 6

amendment to read as recommended by the City Staff.

Mr. Kahn stated that he agrees with Ms. Ratner and will vote the same way.

Mr. Safe stated that the University City Sign Code is one of the most restrictive he has been
exposed to. He does not feel that the applicant or any other tenant of that space should be
required to adhere to higher standards than the rest of the City. Therefore, he will vote for the
amendment as proposed by the City Staff.

Ms. Dunbar asked if each business would be permitted to put up their own separate signs. Mr.
Goldman replied that they would only if they met the restrictions of the Sign Code.

The Plan Commission determined that the evidence presented to the Plan Commission supports
the conclusion that the proposed conditional use amendment: a) Complies with all applicable
provisions of the Zoning Code; b) At the specific location will contribute to and promote the
community welfare or convenience; c) Will not cause substantial injury to the value of
neighboring property; d) Complies with the overall neighborhood development plan and existing
zoning district provisions; and e) Will provide, if applicable, off-street parking and loading areas
in accordance with the standards contained in the Zoning Code. Mr. Kahn moved that the Plan
Commission recommend approval of the Conditional Use Permit Amendment subject to the
following condition:

1. All signs on the premises shall conform in all respects with provisions of the sign
regulations contained in the University City Zoning Code.

The motion was seconded by Ms. Peniston and passed by a vote of 6 to 0, with all members
voting "aye."

Text Amendment to 34-36.4 to create a conditional use in the "RC" - Retail Commercial
District of "Parking Garages and Parking Structures"

Mr. Goldman stated that the recent bond issue included funds for developing additional off-street
parking in the Loop business district. As the City Staff and Administration began to look at the
various possibilities, they became aware that the "RC" - Retail Commercial Zoning District
regulations have no specific provisions for allowing a parking lot or parking structure as a
principal use. Accordingly he suggests that the Plan Commission recommend to the City
Council that Section 34-36.4 of the Zoning Code be amended by adding the following as a
conditional use:

12. Parking lots and parking structures as a principal use, provided the use does not include
the storage of wrecked, damaged or inoperable vehicles.

m-1-2S.plc
