Ms. Glassman moved that preliminary and final approval be given for the plat for the Delson Condominiums, a building located 7417 Delmar on Lot 26 and the East five (5) feet of Lot 27, Block 3 of West Delmar #2. The motion was seconded by Ms. Peniston and passed by a vote of 5 to 0 with all members voting "aye." Text Amendment of §34-38.4 adding as subsection 9 "Child day care center or day nursery" as a conditional use in the "IC" - Industrial Commercial District Chairperson Solodar announced that a hearing was scheduled to hear an application from Carol Mitchell, 1939 Dovershire Ct., St. Louis, MO 63017 for a text Amendment of §34-38.4 adding as subsection 9 "Child day care center or day nursery" as a conditional use in the "IC" - Industrial Commercial District. The Chairperson noted the Commission's procedures and criteria for reviewing text amendments. Chairperson Solodar called on Planning Director Al Goldman to provide the staff report. Mr. Goldman stated that Ms. Carol Mitchell, owner of Kings Child Care Center, Inc. has filed an application for a text amendment to Section 34-38.4 adding "Child day care center or day nursery" to the list of conditional uses that can be authorized by the City Council in the "IC-" Industrial Commercial District. Child care centers of any size are permitted under site plan review in the PR-O, GC and the RC districts and limited child care (up to 30 children) is permitted under site plan review in the LC district. It is permitted only as a conditional use in the PA district. The most recent draft of the proposed zoning code lists "day care centers" among the conditional uses for the "IC" district. In his judgement "child day care centers and day nurseries" are appropriate for inclusion as a conditional use in the "IC" districts and he recommends approval of the application for text amendment. Mr. Walsh moved that the Plan Commission recommend approval of the text amendment of §34-38.4 Conditional Uses in the "IC" - Industrial Commercial District by adding as subsection (9) "Child day care center or day nursery." The motion was seconded by Ms. Glassman and passed by a vote of 5 to 0, with all members voting "aye." Public Hearing: Conditional Use Permit #334, day care in "IC" District, 844 - 848 Kingsland Chairperson Solodar announced that a public hearing was scheduled to hear an application from Carol Mitchell, 1939 Dovershire Ct., St. Louis, MO 63017 for a conditional use permit to have day care center at 844 - 848 Kingsland. The Chairperson noted the Commission's procedures and criteria for reviewing conditional use permits and amendments to them. He specifically stated that the Plan Commission must consider m-8-28.plc
