The willful and knowing failure of <br />the owner of a tower built for shared use to negotiate in good faith with potential <br />users shall be cause for the withholding of future permits to the same owner to <br />install, build or modify antennas or towers within the City. <br />7.General Policies for Site Selection: <br />Community and neighborhood visual concerns shall be considered paramount in the <br />consideration of and selection of sites. These concerns should be evaluated by a <br />consideration of all the policies set forth in this Section which shall include but are not <br />limited to the following: <br />a.Within any zoning district, sites should be located in the following order of <br />preference: <br />1.On existing structures such as buildings, communication towers, water <br />towers, and smokestacks, etc. <br />2.In locations where the existing topography, vegetation, buildings, or <br />other structures provided the greatest amount of screening. <br />3.Sites should be located on bare ground without visual mitigation only in <br />commercial and industrial zone districts. The location and design of <br />sites should consider the impact of the site on the surrounding <br />neighborhood and particularly the visual impact on residential districts <br />that are adjacent to the commercial or residential site. <br />b.Within HR and PR-O Districts, sites shall be located only on buildings 50 feet or <br />more in height with antennas mounted on wall or roof surfaces without the use of <br />towers. <br />8.Maintenance: All facilities shall be maintained and improved to remain in the condition in which <br />they were approved. <br />9.Removal: If any antenna, tower or support structure becomes obsolete or is not used or is inactive <br />for a period of one year it shall be considered a nuisance and be removed at the owner’s expense. <br />10.Permitted Uses: The following telecommunications equipment shall be exempt from the conditional <br />use permit requirements and upon receipt of the appropriate Building Permit are allowed: <br />a.The attachment of additional or replacement antennas, cabinets or shelters to any <br />tower existing on the effective date of this Ordinance or subsequently approved in <br />accordance with these regulations, provided that an additional equipment shelters <br />or cabinets are located within the existing tower site compound area, and that said <br />shelters or cabinets meet all other criteria as established by this Ordinance as <br />required by the applicable zoning district regulations. <br />m-8-27.plc <br /> <br />
