September 24, 1997 Plan Commission Minutes Page 8 <br />The Plan Commission determined that the evidence presented to the Plan Commission supports the <br />conclusion that the proposed conditional use: a) Complies with all applicable provisions of the <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare or <br />convenience; c) Will not cause substantial injury to the value of neighboring property; d) Complies <br />with the overall neighborhood development plan and existing zoning district provisions; and e) Will <br />provide, if applicable, off-street parking and loading areas in accordance with the standards contained <br />in the Zoning Code. Mr. Walsh moved that the Plan Commission recommend approval of the <br />Conditional Use Permit subject to the following conditions: <br />1.Detailed information on the design and appearance of the 30 inch high screen wall at the <br />street perimeter of the parking areas shall be submitted to the Director of Planning for his <br />review and approval. <br />2.Detailed information on the design and appearance of the decorative sight-proof walls on the <br />north property line shall be submitted to the Director of Planning for his review and approval. <br />3.The drive through facility shall be limited to the sale of pharmacy items, over-the-counter <br />drugs and first aid supplies; and the hours of operation should be limited to 7:00 a.m. to 11:00 <br />p.m. <br />4.The control for the inter-communications system for the drive through facility shall be <br />adjusted at all times so that the speakers will not be heard in the surrounding homes. <br />5.The final detailed landscaping plan shall be submitted to the Director of Planning for review <br />and approval shall be obtained before occupancy of the retail building. Landscaping shall be <br />installed and maintained in accordance with the approved plan. The installation shall be <br />completed prior to opening the retail building for public use. Hose hydrants shall be installed <br />on the walls of the building or within planting areas so that all planting can be properly <br />watered. <br />6.Signs shall conform in all respects with the provisions of the sign code. <br />7.Detailed information on utility locations, poles, transformers, exterior meters and air <br />conditioning units the screening of such items shall be submitted to the Director of Planning <br />for his review and approval. <br />8.Sale of alcoholic beverages shall be limited to the hours between 9 a.m. and 10 p.m. <br />9. <br />The operator of the restaurant shall regularly police the site and the neighborhood adjacent to <br />the building to remove litter and debris. <br />10.Exterior lighting fixtures shall be shaded wherever necessary to avoid casting direct light upon <br />any property located in a residential district. <br />The motion was seconded by Mr. Price and passed by a vote of 4 to 0, with all members voting “aye.” <br />Adoption of Proposed Zoning Map and Zoning Code, Chapter 34 of the University City <br />Municipal Code <br />The Plan Commission discussed a proposed zoning code to replace the currently used zoning code. <br />m-9-24.plc <br /> <br />
