August 27, 2003 Plan Commission Minutes Page 3 of 4 <br />Commission members decided that a condition should be added as follows: Storm water drainage <br />problems at the south end of the parking lot shall be resolved as determined by the City Public Works <br />Department. <br />The Plan Commission determined that the evidence presented to the Plan Commission does support the <br />conclusion that the proposed conditional use amendment: a) Complies with all applicable provisions of <br />the University City Zoning Code; b) At the specific location will contribute to and promote the <br />community welfare or convenience; c) Will not cause substantial injury to the value of neighboring <br />property; d) Is consistent with the Comprehensive Plan, neighborhood development plan (if applicable), <br />and any other official planning and development policies of the City; and e) Will provide off-street <br />parking and loading areas in accordance with the standards contained in Article 7 of the University City <br />Zoning Code. Ms. Ricci moved that the Plan Commission recommend approval of the Conditional Use <br />Permit with the following conditions: <br />1.The operator of the restaurant shall regularly police the site and the area adjacent to the <br />restaurant to remove litter and debris. <br />2.Trash containers for patron use shall be available on the premises at all times. Adequate refuse <br />disposal shall be provided by and for the business. The refuse containers and surroundings shall <br />be maintained in a clean condition. <br />3.An exhaust system shall be installed and/or other means shall be taken to prevent any food <br />preparations odors or cooking odors from being perceptible beyond the lot lines of the property <br />on which the restaurant is located. The exhaust system shall be maintained in a clean condition <br />by regularly scheduled cleaning of the system. <br />4.Banquet facility hours of operation shall be limited to those between 9 a.m. and midnight Sunday <br />through Thursday and between 9 a.m. and 1:30 a.m. the following morning Friday and Saturday. <br />Restaurant hours of operation shall be limited to those between 11 a.m and 9:30 p.m. Bakery <br />hours of operation shall be limited to those between 9 a.m. and 7 p.m. <br />5.A final detailed landscaping plan shall be submitted to the Director of Planning for review and <br />approval after consultation with the City Forester. Landscaping shall comply with the <br />requirements set forth in condition #6. Said landscaping shall be maintained in accordance with <br />the approved plan. Said plan shall be approved prior to the issuance of a building permit. <br />6.A sight-proof fence or wall shall be established along southern edge of the parking lot running <br />east-west on the north side of the island. Proposed landscaping shall be shifted to the south in <br />order to accommodate the fence. Said fence or wall shall have a minimum height of six (6) feet <br />but not more than eight (8) feet per Section 34-60.2(1) of the Zoning Code. <br />7.Storm water drainage problems at the south end of the parking lot shall be resolved as <br />determined by the City Public Works Department. <br />The motion was seconded by Ms. Borg and passed by a vote of 5 to 0 with all members voting “aye.” <br />Election of Vice Chairperson <br />Mr. Myers was elected as Vice Chairperson <br />K:\WPOFFICE\WPDATA\m-8-27-2003.plc.wpd <br /> <br />
