Planned Development-Mixed Use (PD-M) <br /> <br /> PD-M developments shall incorporate the regulations set forth in both paragraphs “3” <br />and “4” above dealing specifically with PD-R and PD-C developments. If an unresolved <br />conflict between those regulations occurs (such as between common open space versus site <br />coverage) the applicant shall set forth the reasons for said discrepancy and the proposed <br />resolution. Any discrepancies between the two sets of regulations and the resolution <br />thereof shall be set forth in the map amendment ordinance and/or the resolution <br />approving the development. The resolution thereof shall be pursuant to Staff <br />recommendation or as set forth by the Plan Commission in the map amendment <br />ordinance. <br /> <br /> <br />34-40.14 City council action on preliminary development plan and rezoning request. <br />1. City council action on the rezoning request shall be subject to the provisions of Section 34- <br />162.4, Article 14, “Amendments.” <br />2. If the preliminary development plan is approved by the city council, it shall adopt a <br />resolution approving said preliminary development plan, with conditions as may be specified <br />and authorizing the preparation of the final development plan. <br />3. Simultaneously with the approval of the preliminary development plan, the city council shall <br />adopt an ordinance rezoning the site to the appropriate “PD” district and said ordinance shall <br />include, but not be limited to, the following: <br />a. Legal description of the development site; <br />b. The planned district zoning classification approved; <br />c. Reference to the resolution approving the preliminary development plan and which <br />authorizes preparation of the final development plan; <br />d. A statement requiring approval of a final development plan and plat (if applicable), by the <br />city council, prior to issuing building permits; <br />e. PD-R Developments. The number and type of dwelling units authorized, including number of <br />bedrooms per dwelling unit by type, and the total square footage authorized for any non- <br />residential use permitted; <br />f. PD-C and PD-I Developments. The total square footage authorized for all commercial, office, <br />and/or industrial uses; <br />g. PD-M Developments. The number and type of dwelling units authorized, including <br />number of bedrooms per dwelling unit by type, the total square footage authorized for <br />any non-residential use permitted; and the total square footage authorized for all <br />commercial, office uses; <br />h <br />g. Building and structure height limitations; <br />i <br />h. Minimum building setback requirements; <br />j <br />i. Off-street parking requirements (via reference to Article 7 of the Zoning Code); <br />k <br />j. Reference to Article, “Sign Regulations,” or reference to an approved comprehensive sign <br />plan, as provided for in Section 34-40.7(4)(c); <br />l <br />k.
