June 22, 2005 Plan Commission Minutes Page 5 of 8 <br />3. Trash containers for patron use shall be available on the premises at all times. Adequate refuse <br />disposal shall be provided by and for the business. The refuse containers and surroundings shall <br />be maintained in a clean condition. <br />4.If necessary, an exhaust system shall be installed and/or other means shall be taken to prevent <br />any food preparations odors or cooking odors from being perceptible beyond the lot lines of the <br />property on which the restaurant is located. The exhaust system shall be maintained in a clean <br />condition by regularly scheduled cleaning of the system. <br />5.The hours of operation shall be limited to those between the hours of 6:00 a.m. and 12:00 <br />midnight of the same day. Any changes beyond the limits of these restrictions shall be <br />considered by City Council and only approved by motion after a request in writing by the <br />applicant. <br />6.Seating shall be limited to the layout included in this application for conditional use. Any <br />change in seating layout shall be approved by City Council prior to initiation of such changes. <br />Addition of outdoor seating shall be as approved by the Zoning Administrator. <br />The motion was seconded by Mr. Smith and passed by a vote of 7 to 0 with all members voting “aye.” <br />Public Hearing: Conditional Use Permit, Telecommunications Tower, 975 Pennsylvania <br />The Chairperson announced that this is a continuation of a public hearing that originally took place on <br />April 27, 2005, the hearing was scheduled to hear an application from Cingular Wireless c/o John P. <br />King and Eric Schmitt, 168 N. Meramec Ave., Ste. 400, Clayton, MO 63105. The applicant requests <br />that they be permitted to erect a disguised telecommunications antenna pole (light standard) at 975 <br />Pennsylvania. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use permits <br />and amendments to them. The Chairperson specifically stated that the Plan Commission must consider <br />whether the use: a) Complies with all applicable provisions of the University City Zoning Code; b) At <br />the specific location will contribute to and promote the community welfare or convenience; c) Will not <br />cause substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive <br />Plan, neighborhood development plan (if applicable), and any other official planning and development <br />policies of the City; and e) Will provide off-street parking and loading areas in accordance with the <br />standards contained in Article 7 of the University City Zoning Code. <br />The applicant gave an overview of the proposal and asked that it be approved. Mr. Hill gave the staff <br />recommendation that the application be approved per the Staff Report combined with the extra <br />conditions as submitted by the Cell phone Tower Task Force. <br />Mr. Schmitt stated that the applicants agreed with all proposed conditions but questioned the necessity <br />of the masonry wall around the equipment shelter. Mr. Marentette suggested that condition number 10 <br />be changed to the following, “Applicant shall provide masonry walls and a gate surrounding the <br />K:\WPOFFICE\WPDATA\m-6-22-2005.plc.final.wpd <br /> <br />
