June 22, 2005 Plan Commission Minutes Page 7 of 8 <br />3.All telecommunications antennas and support structures shall meet or exceed current standards <br />and regulations of the FCC and any other state or federal agency with the authority to regulate <br />communications telecommunications antennas and support structures. Should such standards <br />or regulations be amended, then the owner shall bring such devices and structures into <br />compliance with the revised standards or regulations within six (6) months of the effective date <br />of the revision unless an earlier date is mandated by the controlling agency. <br />4.All telecommunications antennas and support structures shall be protected from unauthorized <br />access by appropriate security devices. The outer perimeter of the facility site will be posted <br />with NIER (non-ionizing electro-magnetic radiation) hazard warning signage that also indicates <br />the facility operator and an emergency contact. The emergency contact shall be someone <br />available on a 24-hour a day basis who is authorized by the applicant to act on behalf of the <br />applicant regarding an emergency situation. <br />5.The placement of advertising on antennas and support structures is prohibited. <br />6.Human occupancy for office or other uses by the applicants and/or the applicants’ successors or <br />the storage of other materials and equipment not in direct support of the connected <br />telecommunications antennas by the applicants and/or the applicants’ successors is prohibited. <br />7.All facilities shall be maintained and improved to remain in the condition in which they were <br />approved. <br />8.If the antenna or support structure becomes obsolete or is not used or is inactive for a period of <br />one year it shall be considered a nuisance and be removed at the applicant’s expense. <br />9.Construction, maintenance and operation of the antennas shall be in strict compliance with <br />Section 34-64 of the University City Zoning Code. <br />10.Applicant shall provide masonry walls and a gate surrounding the equipment area. The applicant <br />shall submit designs for the wall to be approved by the Zoning Administrator prior to issuance <br />of the building permit. Said wall shall not be sight-proof and may be constructed of chain link <br />fencing if preferred to be so by the Police Department (for visual and safety purposes). <br />11.A detailed landscaping plan shall be submitted to the Director of Planning and Development for <br />review and approval, in conjunction with a review by the City Forester. Landscaping shall be <br />installed and maintained in accordance with the approved plan. <br />12. The Applicant shall, as a condition of the conditional use permit, provide a financial surety bond <br />payable to the City of University City and acceptable to the City Council to cover the cost of <br />removal of the telecommunications facility and remediation of the landscape. <br />K:\WPOFFICE\WPDATA\m-6-22-2005.plc.final.wpd <br /> <br />
