June 22, 2005 Plan Commission Minutes Page 7 of 8 3.All telecommunications antennas and support structures shall meet or exceed current standards and regulations of the FCC and any other state or federal agency with the authority to regulate communications telecommunications antennas and support structures. Should such standards or regulations be amended, then the owner shall bring such devices and structures into compliance with the revised standards or regulations within six (6) months of the effective date of the revision unless an earlier date is mandated by the controlling agency. 4.All telecommunications antennas and support structures shall be protected from unauthorized access by appropriate security devices. The outer perimeter of the facility site will be posted with NIER (non-ionizing electro-magnetic radiation) hazard warning signage that also indicates the facility operator and an emergency contact. The emergency contact shall be someone available on a 24-hour a day basis who is authorized by the applicant to act on behalf of the applicant regarding an emergency situation. 5.The placement of advertising on antennas and support structures is prohibited. 6.Human occupancy for office or other uses by the applicants and/or the applicants’ successors or the storage of other materials and equipment not in direct support of the connected telecommunications antennas by the applicants and/or the applicants’ successors is prohibited. 7.All facilities shall be maintained and improved to remain in the condition in which they were approved. 8.If the antenna or support structure becomes obsolete or is not used or is inactive for a period of one year it shall be considered a nuisance and be removed at the applicant’s expense. 9.Construction, maintenance and operation of the antennas shall be in strict compliance with Section 34-64 of the University City Zoning Code. 10.Applicant shall provide masonry walls and a gate surrounding the equipment area. The applicant shall submit designs for the wall to be approved by the Zoning Administrator prior to issuance of the building permit. Said wall shall not be sight-proof and may be constructed of chain link fencing if preferred to be so by the Police Department (for visual and safety purposes). 11.A detailed landscaping plan shall be submitted to the Director of Planning and Development for review and approval, in conjunction with a review by the City Forester. Landscaping shall be installed and maintained in accordance with the approved plan. 12. The Applicant shall, as a condition of the conditional use permit, provide a financial surety bond payable to the City of University City and acceptable to the City Council to cover the cost of removal of the telecommunications facility and remediation of the landscape.
