Any <br />change in seating layout shall be approved by City Council prior to initiation of such <br />changes. <br />5. Use of the outdoor dining area and the meeting room shall not occur simultaneously. <br />The motion was seconded by Mr. Senturia and passed by a vote of 6 to 0 with all members voting <br />“yes.” <br />Hearing: Text Amendment - Sections 34-40.7 (3) and 34-40.7 (5) Planned Development <br />District Density Regulations <br />The Chairperson announced that a hearing was scheduled concerning an application from the City <br />for a text amendment to Sections 34-40.7 (3) and 34-40.7 (5) of the Zoning Code concerning the <br />“PD” - Planned Development District Density Regulations. <br />The Chairperson noted the Commission's procedures and criteria for reviewing text amendments. <br />Mr. Hill gave the staff recommendation that the application be approved per the Staff Report. <br />Mr. Byrne moved that the Plan Commission recommend approval of the text amendment as follows <br />bolded <br />(additions are and deletions are stricken): <br />34-40.7 Density and dimensional regulations and performance standards. <br />3. Planned Development-Residential (PD-R). <br />a. Density. The density of residential development shall be consistent with the intent <br />of the original underlying residential district(s). While the district regulations <br />y <br />specifies upper limits to residential density, density of a planned development may <br />be limited to that which is established in the original residential district or which is <br />consistent and compatible with nearby existing developed areas. Conversely, the <br />density limits indicated in the district regulations may be exceeded on portions of <br />the site within a “PD-R” district as long as the total site density limit is not <br />exceeded. This is referred to as “density transfer.” Additionally, the total site density <br />may be exceeded up to a limit, upon conclusion of the plan commission and the <br />council that the density bonus provisions contained in subsection (3)(c) of this <br />section have been satisfied. This is referred to as “density bonus.” <br />b. Calculation of Density. <br />(1) The computation of density shall be based on dwelling units per net acre for the <br />entire site. <br />(2) To compute the number of dwelling units per net acre, fifteen (15) percent of <br />the gross acreage of the parcel shall be deducted and the net acreage divided by the <br />Q:\WPOFFICE\WPDATA\m-2008-02-27.plc.final.wpd <br /> <br />
