September 23, 2009 Plan Commission Minutes Page 2 of 4 <br />Use Permit due to current economic challenges faced with operating a multi-family building in <br />the area. <br /> <br />Questions/comments from the Plan Commission and the responses from the applicant included: <br /> <br />1.Would the music school become a non-profit? No <br /> <br />2.Has the applicant attempted to sell the building to Washington University? No, the <br />applicant wants to retain ownership of the building. <br /> <br />3.How would the clients be sought/school advertised? Through the music union and other <br />resources. <br /> <br />4.Would some units remain residential? Yes <br /> <br />5.Include Sunday as a day of operation <br /> <br />Ms. Riganti provided the staff report and asked that it be approved. Mr. Halpert motioned that <br />the conditional use permit be approved with the following conditions: <br /> <br />1.The hours of operation shall be limited to those between 9:00 a.m. to 9:00 p.m. from <br />Monday through Friday, and 10:00 a.m. to 5:00 p.m. on Saturday and Sunday. <br /> <br />2.The facility shall be operated so that noise complies with the University City Noise <br />Ordinance (Section 9.08.240.2). <br />Playing Radios, Etc. The playing of any radio, phonograph or other musical instrument <br />in such a manner or with such volume as to tend to annoy or disturb the quiet, comfort or <br />repose of persons in any dwelling, hotel or other type of residence; provided, that any <br />such noise that can be distinctly heard at a distance of more than one hundred (100) feet <br />from its source shall be deemed excessive. <br /> <br />3.No recitals shall occur on the premises. <br /> <br />4.No drum lessons shall be conducted after 5:00 p.m. on Monday through Friday. <br /> <br />5.No music or other camps shall occur on the premises. <br /> <br />6.All music school related activity must be operated entirely within the principal building. <br /> <br />7.The exterior appearance of the building shall not be altered in any manner to cause the <br />premises to differ from its residential character. <br /> <br />8.No outdoor storage of materials is permitted. <br />Signage shall be restricted to one wall or window sign not to exceed four (4) square feet. <br />9. <br /> <br />The motion was seconded by Ms. Felton and passed by a voice vote. <br /> <br />Public Hearing: Conditional Use Permit Application – 6655 Washington Avenue <br /> <br /> <br />The Chairperson announced that a hearing was scheduled for a conditional use application for <br />6643 Washington Avenue to permit a private school (music school) in the HR-High Density <br />Residential District. <br /> <br />The Chairperson noted the Commission’s procedures and criteria for reviewing conditional use <br />permits and amendments to them. The Chairperson stated that the Plan Commission must <br />consider whether the use: a) Complies with all applicable provisions of the University City <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare <br /> <br />
