September 23, 2009 Plan Commission Minutes Page 3 of 4 <br />or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and <br />any other official planning and development policies of the City; and e) Will provide off-street <br />parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. <br /> <br />The applicant, Mr. Dan Stevens, 103 E. Lockwood Avenue, St. Louis, Missouri 63119, provided <br />an overview of the proposal. The proposal for this building is consistent with that of 6643 <br />Washington Ave. <br /> <br />Ms. Riganti provided the staff report and asked that it be approved. Mr. Halpert motioned that <br />the conditional use permit be approved with the following conditions: <br /> <br />1.The hours of operation shall be limited to those between 9:00 a.m. to 9:00 p.m. from <br />Monday through Friday, and 10:00 a.m. to 5:00 p.m. on Saturday and Sunday. <br /> <br />2.The facility shall be operated so that noise complies with the University City Noise <br />Ordinance (Section 9.08.240.2). <br />Playing Radios, Etc. The playing of any radio, phonograph or other musical instrument <br />in such a manner or with such volume as to tend to annoy or disturb the quiet, comfort or <br />repose of persons in any dwelling, hotel or other type of residence; provided, that any <br />such noise that can be distinctly heard at a distance of more than one hundred (100) feet <br />from its source shall be deemed excessive. <br /> <br />3.No recitals shall occur on the premises. <br /> <br />4.No drum lessons shall be conducted after 5:00 p.m. on Monday through Friday. <br /> <br />5.No music or other camps shall occur on the premises. <br /> <br />6.All music school related activity must be operated entirely within the principal building. <br /> <br />7.The exterior appearance of the building shall not be altered in any manner to cause the <br />premises to differ from its residential character. <br /> <br />8.No outdoor storage of materials is permitted. <br />Signage shall be restricted to one wall or window sign not to exceed four (4) square feet. <br />9. <br /> <br />The motion was seconded by Ms. Greening and passed by a voice vote. <br /> <br />Hearing: Map Amendment for 547 and 551 North and South Road <br /> <br />Mr. John Nations, One Metropolitan Square, Suite 2600, attorney for the applicant, presented the <br />application. 547 and 551 North and South Road are currently zoned LR – Limited Residential, <br />which permits single and two-family dwellings. This application would rezone the properties <br />from LR – Limited Residential to LC – Limited Commercial. The applicant would like to <br />construct an off-street parking lot on the two vacant parcels to support its operations at Dewey’s <br />Pizza on the parcel to the north (559 North and South). <br /> <br />Comments/questions from the Plan Commission and the applicant’s responses include: <br /> <br />1.Will the proposed rezoning create additional employment opportunities? Yes, through <br />construction jobs. <br /> <br />
