January 28, 2009 Plan Commission Minutes Page 3 of 5 <br />proposal and asked that it not be approved. No other members of the public wished to speak and <br />the public hearing was closed. <br /> <br />The Plan Commission determined that the evidence presented to the Plan Commission does <br />support the conclusion that the proposed conditional use or amendment thereto: a) Complies <br />with all applicable provisions of the University City Zoning Code; b) At the specific location <br />will contribute to and promote the community welfare or convenience; c) Will not cause <br />substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive <br />Plan, neighborhood development plan (if applicable), and any other official planning and <br />development policies of the City; and e) Will provide off-street parking and loading areas in <br />accordance with the standards contained in Article 7 of the University City Zoning Code. Mr. <br />Halpert moved that the Plan Commission recommend approval of the Conditional Use Permit <br />with the following conditions: <br /> <br /> <br />1.The operator shall regularly police the site and the area adjacent to the building to remove <br />litter and debris. <br /> <br /> <br />2.Trash containers for patron use shall be available on the premises at all times. Adequate <br />refuse disposal shall be provided by and for the business. The refuse containers and <br />surroundings shall be maintained in a clean condition. <br /> <br /> <br />3.The hours of operation shall be limited to those between the hours of 8 a.m. and 7 p.m. <br />(proposed hours being 9 a.m. to 6 p.m.). <br /> <br /> <br />4.The facility shall be operated so that noise complies with the University City Noise <br />Ordinance (Section 9.08.240). <br /> <br /> <br />5.No outdoor overnight storage of vehicles shall be permitted on the property. <br /> <br /> <br />6.Besides the moving of serviced vehicles, all activities (including washing, detailing and <br />cleaning) shall take place within the building. <br /> <br />The motion was seconded by Mr. Miller and passed by a vote of 5 to 1 with Mr. Halpert, Ms. <br />A@ <br />Greening, Mr. Byrne, Mr. Miller and Mr. Senturia voting yes and Mr. Marentette voting “no.” <br /> <br />Public Hearing: Conditional Use Permit Amendment, Auto-detailing Facility (vehicle <br />service facility), 1040 North & South <br /> <br /> <br />The Chairperson announced that a public hearing was scheduled to hear an application from <br />McKnight Place Assisted Living, LLC c/o Nick Walker, 1 McKnight Place, University City, MO <br />63124 to amend the previously granted Conditional Use Permit (which had granted an expansion <br />q:\wpoffice\wpdata\zoning_files_1991_to_2009\minutes_agendas_plc\m-2009-01-28.plc.doc <br /> <br />
