Installation of the paint booth will allow the business to take on <br />larger jobs while remaining at their current location. <br /> <br />Questions/comments from the Plan Commission and responses from the applicant and/or staff <br />included: <br /> <br />1.What happens to any effluence associated with the paint booth? Applicant: The paint <br />booth is designed to keep everything contained as well as filter any particles. It is <br />approved by the EPA. <br /> <br />2.Will there be any effect on surrounding properties? Applicant: No, the booth is designed <br />to contain everything. <br /> <br />3.Is there any way to measure what is being released? Applicant: Yes, the paint booth has <br />meters that show that information as well as if any filters need to be replaced. <br /> <br />4.What about any liquid effluence? Applicant: It is stored onsite and picked up by a <br />company that specializes in that. <br /> <br />5.Regarding the exterior of the building, will anyone notice any changes? Applicant: No <br />major exterior changes, only a duct in the roof. <br /> <br />6.Will this affect any surrounding businesses? Applicant: No, the paint booth is designed <br />to contain everything. <br /> <br />7.Have you discussed this with any of your neighbors? Applicant: No. Staff: They were <br />notified about tonight’s public hearing. <br /> <br />Staff explained the reason a conditional use permit was required. Based on the definitions in the <br />Zoning Code, the current business is defined as a “vehicle service facility” which is a permitted <br />use in the IC District. Installation of the paint booth would change the business as defined in the <br />Zoning Code to a “vehicle repair facility” which is a conditional use in the IC District. <br /> <br />Staff presented the staff report and asked that it be approved with the following conditions: <br /> <br /> <br />1.A building permit must be obtained prior to installation of the paint booth. The applicant <br />must adhere to all requirements of the Building Plans Examiner. <br /> <br />2.Processes and equipment employed and goods processed or sold shall be limited to those <br />which are not objectionable by reason of odor, dust, smoke, noise, vibration, refuse, <br />water-carried waste, pollutants or other matter which in any manner creates a nuisance <br />beyond the property line of a particular use (also see Article 5, Division 34-66 for <br />performance standards). <br /> <br />3.Hours of operation shall be limited to Monday through Friday, 8 am to 5 pm. <br /> <br />After further discussion, the Plan Commission requested that the limitation on the hours of <br />operation be changed to Monday through Saturday, 7 am to 7 pm.
