AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE CITY OF UNIVERSITY CITY, MISSOURI, RELATING TO ZONING DISTRICTS ESTABLISHED PURSUANT TO SECTION 34-22 THEREOF, AND ENACTING IN LIEU THEREOF A NEW OFFICIAL ZONING MAP, THEREBY AMENDING SAID MAP SO AS TO CHANGE THE CLASSIFICATION OF PROPERTY AT 8342 DELCREST FROM "PA" - PUBLIC ACTIVITY DISTRICT, TO "HRO" - HIGH DENSITY RESIDENTIAL-OFFICE DISTRICT; CONTAINING A SAVINGS CLAUSE AND PROVIDING A PENALTY. WHEREAS, Chapter 34 of the Municipal Code of the City of University City (University City Zoning Code) divides the City into several zoning districts, and regulates the character of buildings which may be erected in each of said districts, and the uses to which the buildings and premises located therein may be put; and WHEREAS, the City Plan Commission examined an amendment of the Official Zoning Map of the City which changes the classification of property at 8342 Delcrest from Public Activity District ("PA") to High Density Residential-Office District ("HRO"); and WHEREAS, the City Plan Commission, in a meeting at Screenz Computing Center, 6680 Delmar, University City, Missouri on July 26, 2006, approved said amendment and recommended to the City Council that it be enacted into an ordinance; and WHEREAS, due notice of a public hearing to be held by the City Council in the City Council Chambers, th 5 floor, at City Hall at 6:30 p.m., August 28, 2006, was duly published in the St. Louis Countian, a newspaper of general circulation within said City on August 1, 2006; and WHEREAS, said public hearing was held at the time and place specified in said notice, and all suggestions or objections concerning said amendment of the Official Zoning Map of the City were duly heard and considered by the City Council. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Chapter 34 of the Municipal Code of the City of University City, Missouri, relating to zoning is hereby amended by repealing the Official Zoning Map illustrating the zoning districts established pursuant to Section 34-22 thereof, and enacting in lieu thereof a new Official Zoning Map, thereby amending the Official Zoning Map so as to change the classification of property at 8342 Delcrest, from Public Activity District ("PA") to High Density Residential-Office District ("HRO"). Section 2. Said property at 8342 Delcrest is more fully described as follows: A tract of land being part of Lot 6, all of Lots 7 and 8 of Delcrest Subdivision, a subdivision recorded in Plat Book 45 page 46 of the St. Louis County Land Records Office in St. Louis County, Missouri, being more particularly described as follows: Beginning at the southwest corner of Lot 8 of the aforementioned Delcrest; thence northwardly along the common lines of Lots 8 and 9; North 38 degrees 58 minutes 00 seconds East a distance of 346.16 feet to the northwest corner of Lot 8; said point being on the southern right of way of Delcrest Drive (60’ wide); thence along said right of way along a curve to the left, whose radius point bears North 38 degrees 57 minutes 56 seconds East, having a radius of 822.00 feet, an arc length of 405.80 feet; a delta of 28 degrees 17 minutes 08 seconds; thence leaving said right of way South 11 degrees 40 minutes 43 seconds West a distance of 671.59 feet to a point; thence South 54 degrees 30 minutes 00 seconds West a distance of 41.25 feet to a point on the northern right of way line of the St. Louis Belt and Terminal Railroad right of way (100’ wide); thence along said right of way line north 35 degrees 30 minutes 00 seconds West a distance of 584.80 feet to a point; thence along a curve to the right having a radius of 5679.65 feet, an arc length of 128.00 feet and a delta of 01 degrees 17 minutes 29 seconds to the
