<br />Q. ADJOURNMENT <br /> Mr. Glickert moved to go into Executive session according to <br />RSMo610.0210(1) Legal, pertaining to legal actions, causes of action or litigation <br />involving a public governmental body and any confidential or privileged communication <br />between a public governmental body or its representatives and its attorney. The motion <br /> <br />was seconded by Mr. Sharpe. <br /> <br />Mr. Kraft said this executive session was inappropriate. He said retaining special <br />counsel was not something that should be done in a closed meeting and therefore will <br />vote against it. Mr. Kraft said we checked with the State’s Attorney’s office and they <br />agreed. <br /> <br />Mr. Price called for a Point of Order and asked “who” checked. He felt it was <br />inappropriate to bring that opinion to the floor without following procedure. Mr. Price <br />asked if that was proper protocol. <br /> <br />Mayor Welsch said she assumed that Mr. Kraft did his own research in before making <br />his decision on how he would vote. <br /> <br />Mr. Kraft said all he was doing was giving his opinion that this is not covered under the <br />Sunshine Law and if found not to be legal he is immune from any sanctions. <br /> <br />Mr. Crow asked the chair to ask Mr. Mulligan to give his opinion. Mayor Welsch asked <br />Mr. Walker if Mr. Mulligan could speak. Mr. Walker answered in the affirmative. <br /> <br />Mr. Mulligan said in his opinion the Council may discuss whether or not to retain special <br />counsel in a closed session regarding pending litigation. <br /> <br />Roll Call vote on the motion to go into an Executive session was: <br /> <br />AYES: Mr. Price, Mr. Crow, Mr. Glickert, Mr. Sharpe, Mayor Welsch <br />NAYS: Mr. Kraft <br /> <br />Meeting was adjourned at 8:15 p.m. <br /> <br />Joyce Pumm, MRCC <br /> <br />City Clerk <br />
