Mr. Sharpe asked Mr. Mulligan if the only choice was to vote yes on this. Mr. <br />Mulligan stated that it was based on the standards set out in the ordinance and if <br />the Council decides this applicant does meet the criteria then it should be approved. <br /> <br />Ms. Ricci asked Mr. Mulligan if what he describes as charitable does not mean <br />charitable in a tax sense but rather it is not-for-profit. <br /> <br />The voice vote carried unanimously. <br /> <br />L. COUNCIL REPORTS AND BUSINESS <br />1. <br />Council liaison reports on Boards and Commissions. <br />Mr. Glickert spoke on the Civil Service Board meeting on April 20 and reported that <br />the Board approved the Youth Employment Program for this summer. He <br />congratulated the City and the Civil Service Board on retooling and redefining some <br />of the elements of that program. Mr. Glickert said instead of having a wholesale <br />group of students doing one thing, now there will be the opportunity for these <br />students to participate in various disciplines within the City. These students will have <br />requirements to meet before they are approved. <br /> <br />M. UNFINISHED BUSINESS <br /> <br />BILLS <br />1. <br />BILL 9111 - An ordinance amending Chapter 2.10 of the University City Municipal <br />Code, relating to the Finance Department, by enacting therein a new section to be <br />known as “Section 2.10.070 transfer of unexpended appropriations within a budget <br />classification.” <br /> <br />CITIZEN COMMENTS <br />Paulette Carr <br />Ms. Carr noted she was present for the third time to speak against the proposal to <br />grant budget transfer authority from the City Council to the City Manager. She <br />quoted from Section 38 of the City Charter describing the transfer of unexpended <br />appropriations and Ms. Carr noted that it is the responsibility and the power of the <br />Council not the City Manager. She stated the Charter makes no distinction between <br />inter-classifications and intra-classifications. Ms. Carr stated the process of the <br />transfer of unexpended appropriations by the Council with a resolution and a public <br />vote allows for transparency and accountability. <br /> <br />Frank Ollendorff, 8128 Cornell Ct <br />Mr. Ollendorff noted that in a Council-Manager form of government the City Manager <br />is responsible for preparing the budget and presenting it to Council for adoption. He <br />noted that with the proper budget management, the City Manager is responsible to <br />facilitate timely budget amendments as prescribed by Council-Manager Home Rule <br />Charter. Mr. Ollendorff said that budget changes must be in public by a Resolution <br />and if the City Manager is authorized to decide it is not transparent and is not <br />reported for months after the amendment. <br /> <br />Ms. Ricci said she has long objected to lack of accountability as to the way budget <br />transfers were handled before. She noted she had sought the opinion of the State <br />Auditor, who thought it was fine, and finally got the City’s legal opinion that this is not <br />a resolution as quoted in the Charter but rather is an ordinance. She said the <br />Charter sets out additionally that the City Manager is going to perform all other duties <br />as may be prescribed of him by Council not inconsistent with the Charter, The <br />difference is rather than a department head asking for a transfer the City Manager is <br /> <br />
