AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE CITY OF UNIVERSITY CITY, RELATING TO ZONING, BY REPEALING SECTION 34-77.2 THEREOF RELATING TO REFERRAL TO THE HISTORIC PRESERVATION COMMISSION, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 34-77.2 REFERRAL TO THE HISTORIC PRESERVATION COMMISSION," BY AMENDING SAID SECTION SO AS TO NOT REQUIRE REFERRAL IN THE INSTANCE WHERE A BUILDING PERMIT IS LOCATED WITHIN A PRIVATE SUBDIVISION THAT IS ON THE NATIONAL HISTORIC REGISTRY BUT IS NOT WITHIN A UNIVERSITY CITY DESIGNATED HISTORIC DISTRICT; CONTAINING A SAVINGS CLAUSE AND PROVIDING A PENALTY. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: WHEREAS, at its meeting held at City Hall at 6:30 p.m. on September 27, 2006, the University City Plan Commission recommended an amendment of Section 34-77.2 of the University City Zoning Code by adding provisions that do not require referral in the instance where a building permit is located within a private subdivision that is on the National Historic Registry but is not within a University City designated Historic District; and WHEREAS, due notice of public hearings to be held by the City Council in the City Council Chambers at City Hall at 6:30 p.m. on ____________________, was duly published in the St. Louis Countian, a newspaper of general circulation within said City; and WHEREAS, said public hearings were held at the time and place specified in said notice, and all suggestions or objections concerning said amendment were duly heard and considered by the City Council; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Chapter 34 of the Municipal Code of the City of University City, Missouri, relating to zoning is hereby amended by repealing Section 34-77.2, relating to Referral to The Historic Preservation Commission, and enacting in lieu thereof a new section to be known as "Section 34-77.2 Referral to The Historic Preservation Commission," by amending said section so as to not require referral in the instance where a building permit is located within a private subdivision that is on the National Historic Registry but is not within a University City designated Historic District, as so amended shall read as follows: 34-77.2 Referral to historic preservation commission.
