<br />6. Reporting Requirements. All owners, keepers or harborers of pit bull <br />dogs must, within ten days of any of the following incidents, report said <br />information in writing to the director of public works: <br /> <br /> a. The removal from the city of death of a bit bull dog; <br /> b. The birth of offspring of a pit bull dog; <br />c. The new address of a pit bull dog owner should the owner move <br />from one address within the corporate city limits to another <br />address within the corporate city limits; <br />d. The bodily injury to or death of a person caused by a pit bull dog. <br /> <br />7. Sale of Transfer of Ownership. No person shall sell, barter or in any <br />other way dispose of a pit bull dog to any person within the city; <br />provided that the owner of a pit bull dog may sell or otherwise dispose of <br />a dog or the offspring of such dog to persons who do not reside within <br />the city. <br /> <br />8. Animals Born of Dogs Registered Hereunder. All offspring born of pit <br />bull dogs within the city must be removed from the city within six weeks <br />of their birth. <br /> <br />9. Failure to Comply. It is unlawful for the owner, keeper or harborer of a <br />pit bull dog within the city to fail to comply with the limitations, <br />requirements and conditions set forth in this section. Any dog found to <br />be the subject of a violation of this section shall be subject to revocation <br />of the license and/or registration of the animal and immediate seizure <br />and impoundment. The owner shall be required to take necessary <br />action to dispose of such pit bull and the director of public works is <br />further authorized to dispose of such pit bull if necessary action is not <br />taken by the owner. <br /> <br />10. Violations and Penalties. Any person violating or permitting the violation <br />of any provision of this section shall, upon conviction in municipal court, <br />be fined a sum not less than four hundred dollars ($400.00) and not <br />more than one thousand ($1,000.00). In addition to the fine imposed, <br />the court may sentence the defendant to imprisonment in the city jail or <br />other authorized penal institution for a period not to exceed one year. In <br />addition, the court shall order the registration of the subject pit bull dog <br />revoked and the dog removed from the city. Should the defendant <br />refuse to remove the dog from the city the municipal court judge shall <br />find the defendant owner in contempt and order the immediate <br />confiscation and impoundment of the animal. Each day that a violation <br />of this section continues shall be deemed a separate offense. In <br />addition to the foregoing penalties, any person who violates this section <br />shall pay all expenses, including shelter, food, handling, veterinary care <br />and testimony necessitated by the enforcement of this section. <br /> <br />Section 2. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation from any penalty heretofore incurred by the violation of Chapter 6.08, Section <br />6.08.110, nor bar the prosecution for any such violation. <br /> <br /> <br />
