To: Honorable Mayor Adams and City Council

From: Julie Feier, City Manager

Date: November 16, 2006

Subject: Weekly Update

Two weeks ago, I presented you the proposal by Millstone Bangert, Inc,
-170 & Olive Interchange
contractor for the I. Essentially, the proposal
suggested altering the original construction schedule fromthe start date in
:
September 2006 (which occurred) and a completion date of November 2008.
During which time the Contractor was required to maintain all ramps open
throughout the construction. The shift is to a plan wherein the construction would
end by December 22, 2007. To accomplish the more aggressive completion
date, MODOT must agree to allow the ramps to be closed as follows:

May and June, 2007 - Drivers southbound I-170 will not be able to
?

access Olive

July and August, 2007 - Drivers on Olive would not be able to access I-
?

170 North

September and October, 2007 - Drivers northbound I-170 will not be able
?

to access Olive

The proposal includes an incentive of $10,000 per day up to 14 days for early
completion on each ramp and including the opening of three lanes of I-170 in
each direction. The incentive maximum value is capped at $560,000 and the
penalty, which has no cap, would be instituted should closure time exceed the 54
calendar days proposed or if three lanes of I-170 in each direction are not open
by Dec 22, 2007. A $10,000 per day penalty would be charged to the contractor
each day beyond the scheduled completion date. With that kind of money on
the table, I would anticipate a completion prior to December 22, 2007.
