A <br /> RESOLUTION 2012 -01 <br /> RESOULTION RESTATING AND REVISING THE CITY'S <br /> VOLUNTARY FLOOD BUYOUT POLICY FOR THE WILSON <br /> AVENUE VOLUNTARY FLOOD BUYOUT PROJECT <br /> WHEREAS, in accord with the State Emergency Management Agency's (SEMA) Hazard Mitigation <br /> Grant Program, and as approved by the Federal Emergency Management Agency (FEMA), the Council for <br /> University City adopted Resolution 1 o. September 20, 2010 establishing the University City Voluntary <br /> Buyout Policy (the "Policy") for the acquisition of certain flood-risk properties located on Wilson Avenue; and <br /> WHEREAS, SEMA has informed the City that the Policy must be revised in accord with the Hazard <br /> r <br /> Mitigation Assistance Guidance Policy to address the acquisition of any properties purchased or foreclosed by <br /> third-parties after the flood incident giving rise to the Policy; and <br /> WHEREAS, the Council now desires to revise the Policy to encompass such "post-flood" transactions <br /> and to restate the Policy in all other respects; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF UNIVERSITY CITY, <br /> MISSOUR, AS FOLLOWS: <br /> Section 1. The University City Voluntary Buyout Policy is hereby revised by the inclusion of new <br /> language addressing the acquisition of any properties purchased or foreclosed by third-parties after the flood <br /> incident giving rise to the Policy, which such language is high-lighted in the attached Exhibit A, incorporated <br /> by reference. <br /> s <br /> i <br /> Section 2. The Council for University City further restates and reaffirms the Policy, as presented in the <br /> attached Exhibit A, in all other respects. <br /> Section 3. The Mayor, the City Manager and all other officers, employees, and representatives of the <br /> City remain authorized and directed to take such other action as may be necessary or desirable to implement the <br /> Policy. <br /> i <br /> Section 4.
