Session 1702, Minutes <br />July 28, 1997 <br /> <br />10 <br /> <br />Mr. Wagner advised them to unincorporate and therefore, remove the target. He does not see that the benefrts outweigh <br />the problems that they have created for themselves. <br /> <br />Mayor Adams said that he disagreed with Mr. Wagner. He said that there was a need to be incorporated. In order to deal <br />with the variety of entities through the Fair they have to have this tax exempt status. This allows the Fair in the Square to <br />operate without having to pay taxes on the prom that is made from whatever is sold. If they had to pay taxes, they would <br />not be able to go to the charitable organizations for assistance. Mr. Wagner commented that for decades, the Fair had <br />never had to do this. Mayor Adams said that this was correct, but that they were probably in violation of numerous laws. <br /> <br />Mr. Munkel mentioned Fair St. Louis, and wondered how they handled this problem and whether or not Mr. Sulser had <br />considered talking with them about it. Mr. Sulser said that they considered looking into this. He would try to contact the <br />City Counselor's oEce, but to his knowledge, no one has undertaken that task. Mr. Munkel said due to the size and the <br />number of years that Fair St. Louis has operated that there must some way to cover themselves from legal liability. <br /> <br />Mr. Ollendorffsald that he did not have any idea what insurance costs. He thought that they could meet with <br />representatives of the Fair after they check on it. If they could §nd out what insurance would cost, it should solve the <br />problem, as long as it was something that all parties could afford. Mayor Adams said that this should be looked at and an <br />exact statement of coverage should be developed. Quotes would need to be obtained by brokers. <br /> <br />Mayor Adams informed Council that he was the one that was lukewarm about the Fair becoming a commission. He <br />believes that a self perpetuating board dealing with this would be more responsive than a commission of the City Council. A <br />self perpetuating board can maintain its membership and expand itself when needed. <br /> <br />PERSONNEL REPORT <br /> <br />The Personnel report for the period ending July 25, 1997, was received and ordered filed. <br /> <br />CITI7FN COMMENTS: <br /> <br />The Mayor called forward citizens who wished to speak on non-agenda issues. <br /> <br />Ms. Sydney Mann, 745 Eastgate #3N, wanted to discuss the facility hours at Heman Park Pool. She regularly uses the <br />facility and has been a resident for three years. She had heard that there was some opposition to the family swim time <br />hours a few weeks ago and that some people were hoping to have that changed so that the pool population would be <br />consistent all day and all weekend. She said that as a mother with a small child, she noticed that the pool population from <br />5:00 p.m. to 8 p.m. was a majority of parents with young children. She said that she and others she knows are in support <br />of retaining the family swim hours, Monday through Friday, because the pool is less crowded and more conducive to <br />parents with young children. <br /> <br />Beth Robertson, 725 Kingsland Ave., #301, is here to express her desire to have an off leash dog recreation area <br />somewhere within University City. She said that she had presented her request to the Park Commission and they told her <br />that there would have to be an amendment to the leash laws. She said that she was working on a petition to demonstrate <br />to the Park Commission and City Council that she is not the only dog owner that would like to see this happen. California <br />and New York have off leash dog parks and have some good rules: All dog owners must carry a leash, dogs must be under <br />voice control and within sight of their owners, dog owners must clean up after their dogs, dogs showing signs of aggression <br />must be leashed immediately, owners must fill any holes by their dogs. She thinks these would be outstanding rules. She is <br />aware that there is a dog clean up ordinance and she sees that it is not really complied with. <br /> <br /> <br />
