<br />proposed District is set forth as Exhibit B, attached hereto and incorporated herein by reference. <br />The proposed District is located entirely within the City. <br /> <br />7. The cost of any proposed improvement to be assessed against the property within the District <br />shall be apportioned against such property in accordance with the benefits accruing thereto by <br />reason of such proposed improvement. <br /> <br />8. The proposed method of assessment is for the cost to be assessed against the property in an equal <br />amount per platted lot based upon a total of 265 platted lots. <br /> <br />9. For purposes of determining the method of assessment, each property address within the District <br />as shown on Exhibit A shall be deemed to be one (1) platted lot, except that: <br /> <br />a) The property at 420 Midvale Avenue shall be deemed to be sixteen (16) platted lots, <br />b) The property at 7393 Pershing Avenue shall be deemed to be four (4) platted lots <br />c) The property at 7200 Delmar Blvd. shall be deemed to be three (3) platted lots <br />d) The property at 7286 Creveling Drive shall be deemed to be three (3) platted lots <br />e) The property at 7228 Creveling Drive shall be deemed to be two (2) platted lots <br />t) The property at 536 Overhill Drive shall be deemed to be two (2) platted lots <br />g) The property at 7390 Kingsbury Boulevard shall be deemed to be one half (112) of a platted <br />lot <br />h) The property at 7392 Kingsbury Boulevard shall be deemed to be one half (112) of a platted <br />lot <br /> <br />10. The Subdivision estimates the cost of the proposed improvement in paragraph 5 is $728,000. <br /> <br />11. The petitioners agree to the establishment of a maintenance fund for the benefit of the <br />subdivision for the application of a second layer of chip seal to all streets as indicated in <br />paragraph 5(t), which application shall occur after payment in full of assessments against the real <br />property within the District but not before a maximum time period of fifteen years. <br /> <br />12. The final cost of the proposed improvement shall not exceed twenty-five percent of the estimated <br />cost provided in paragraph 10. <br /> <br />13. The final cost for the proposed improvement shall not exceed $910,000. <br /> <br />14. The petitioners agree that the final cost of the proposed improvement assessed against the <br />property within the District shall not exceed a maximum total final cost of $3,433.96 per platted <br />lot. <br /> <br />15. The Subdivision Trustees are authorized to construct and manage the project improvements, <br />prepare the preliminary plans and specifications, prepare the costs estimates, and complete the <br />construction of the project improvements in accordance with the plans and specifications. <br /> <br />16. At the completion of the proposed improvement in paragraphs 5(a) through 5(e), the City is <br />authorized to compute the final cost of the proposed improvement and to assess each property <br />owner for the final cost of the proposed improvement, not to exceed a maximum of $3,433.96 <br />per platted lot. <br />
