BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS <br />: <br /> <br />Section 1: Chapter 8.24 of the University City Municipal Code, relating to <br />nuisances, is hereby amended by enacting therein a new section to be known as <br />“Section 8.24.280 Places used for the unlawful possession or consumption of <br />alcoholic beverages by minors – Social parties”, which shall read as follows: <br />Section 8.24.280 Places used for the unlawful possession or <br />consumption of alcoholic beverages by minors – Social parties. <br />A. Definitions. As used in this section: <br /> “Alcoholic beverages” means intoxicating liquor or nonintoxicating <br />beer, as those terms are defined in Section 5.08.010 of this Code. <br /> “Minor” means any person under twenty-one (21) years of age. <br /> “Person in control of a place” means a person eighteen (18) years <br />of age older who owns, possesses, occupies, leases or rents a <br />place. <br /> “Place” means any building, dwelling unit, lot, plot or parcel of <br />land, premises, room or structure. <br /> “Social party” means a social gathering of persons at a place. <br />B. Any place which is used for a social party where there is unlawful <br />possession or consumption of an alcoholic beverage by a minor is <br />a public nuisance. <br />C. It is unlawful for any person in control of a place used for a social <br />party to knowingly or negligently permit any minor to unlawfully <br />possess or consume an alcoholic beverage at the place. <br />D. It is unlawful for any person in control of a place used for a social <br />party to leave the place without taking reasonable steps to prevent <br />the unlawful possession or consumption of an alcoholic beverage <br />by a minor at the place. <br />Section 2. This ordinance shall not be construed so as to relieve any <br />person, firm or corporation from any penalty heretofore incurred by the violation <br />of Chapter 8.24, nor bar the prosecution for any such violation. <br /> <br /> <br />
