6801 Delmar Boulevard, University City, Missouri 63130, Phone: (314) 682-6767 <br /> <br />RESOLUTION OF THE UNIVERSITY CITY COUNCIL IN <br />OPPOSITION TO SENATE BILL 307 WHICH WOULD <br />ELIMINATE MONETARY CAPS ON MUNICIPAL LIABILITY. <br /> <br /> WHEREAS, under the current law, cities are liable for motor vehicle <br />accidents caused by certain conditions on city property for amounts up to <br />$100,000 per person and $1,000,000 per incident; and <br /> <br /> WHEREAS, Senate Bill 307 proposes to eliminate these monetary caps on the <br />liability of cities while retaining such limitations with state, counties, schools and all <br />other governments; and <br /> <br /> WHEREAS, the Council of University City believes that the removal of these <br />monetary limitations would be a serious detriment to the operations of the city <br />with respect to parks, street maintenance and other municipal operations; and <br /> <br /> WHEREAS, the removal of these monetary caps would dramatically increase <br />the cost of municipal liability insurance thereby jeopardizing the financial stability <br />of the cities. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY AS FOLLOWS: <br /> <br /> Section 1: The City Council of the City of University herein declares its <br />opposition to Senate Bill 307 which would eliminate the monetary caps on <br />municipal liability for proprietary functions and encourages the Missouri Senate to <br />oppose the adoption of Senate Bill 307. <br /> <br /> Section 2 The City Clerk is hereby directed to send a copy of this <br />Resolution to Senator Wayne Goode, Senator Betty Sims, and Senator John D. <br />Schneider. <br /> <br />Adopted this 10th day of April, 1995. <br /> <br />ATTEST: <br /> <br />City Clerk <br /> <br /> <br />
