<br /> <br /> <br />UNIVERSITY CITY COUNCIL <br />STUDY SESSION <br />Heman Park Community Center <br />975 Pennsylvania <br />January 30, 2013 <br />6:00 p.m. <br /> <br />The City Council Study Session was held in the Heman Park Community Center, on <br />January 30, 2013. Mayor Shelley Welsch called the Study Session to order at 6:07 p.m. <br />In addition to the Mayor Welsch, the following members of the Council were present: <br />Ms. Paulette Carr <br />Mr. Terry Crow <br />Mr. Byron Price <br />Mr. Stephen Kraft <br /> <br />Mr. Michael Glickert was excused. <br /> <br />Also in attendance was City Manager Lehman Walker; staff members: Director of <br />Community Development Andrea Riganti, Deputy Director of Economic and Community <br />Development, Raymond Lai. <br /> <br />Mayor Shelley Welsch opened the study session meeting and turned it over to City <br />Manager Mr. Walker. Mr. Walker stated that staff had a very brief presentation of events <br />leading up the draft Intergovernmental Agreement between University City and Olivette. <br />He noted that both the City attorney Mr. Paul Martin and the attorney representing the <br />Joint Redevelopment Implementation Committee (JRIC), Mr. Jim Mello from Armstrong <br />Teasdale, were present to answer any questions from University City Council. Mr. Walker <br />asked the Director of Community Development Andrea Riganti and Deputy Director of <br />Economic and Community Development, Raymond Lai to give a brief review and overlay <br />of the Intergovernmental Agreement. Mr. Walker noted that he provided Council with the <br />draft agreement along with City Attorney Mr. Martin’s legal opinion of the agreement. <br /> <br />Questions and Answers: <br />Q: <br /> Mr.Kraft asked about the power of a 353 Corporation representing U City and Olivette. <br />In specific, he asked about eminent domain power. <br />A: <br /> Mr. Mello said a 353 Corporation does not have the power of eminent domain nor to <br />provide a tax-abatement. Only the City Council has that authority as per the State <br />Statute. <br /> <br />Q: <br /> Mr. Kraft asked who would approve a development proposed. <br />A: <br /> Mr. Mello said that the project would have to fit in the master overlay plan, which <br />would need to be approved by the City Council. He said the project would be <br />presented to the 353 Commission. Mr. Martin stated that if a developer came in with <br />plans that meet the zoning overlay as approved by the Council, the JDC (note: this is <br />an entity to be created) would have the authority to approve it. <br /> <br />Q: <br /> Mr. Kraft asked how code enforcement would be handled. <br />A: <br /> Mr. Mello stated the code would be developed by the 353 Corporation and enforced by <br />each City.
