<br /> <br />Mr. Crow stated this would discourage frank communication and raise the citizen’s <br />expectations that more items would be made public than the Council would like. <br /> <br />Mr. Martin stated yes. <br /> <br />Mr. Crow asked if the action that was taken by the Mayor was beyond the authority of one <br />member. <br /> <br />Mr. Martin stated he thought the answer would probably be yes. <br /> <br />Mr. Crow stated that they have legal opinions from February 5, 2013, that have the <br />disclaimer and because these have been placed in the public domain, has the attorney- <br />client privilege been waived. <br /> <br />Mr. Martin stated that to the extent of those documents that are in the public domain, yes. <br /> <br />Mr. Crow stated that Council got the waiver on the opinion for the Proposition U and the <br />Olivette and University City Intergovernmental Agreement that has been waived <br />unilaterally. Mr. Crow commended Mr. Kraft regarding his statement at the November 26, <br />2012, meeting. He said Mr. Kraft said they usually do not have the City Attorney’s opinion <br />made public; however, he would like to ask Council that the City Attorney’s opinion be <br />made public in this matter so the public would know the reason behind the <br />recommendation and was passed unanimously. Mr. Crow stated that he keeps coming <br />back to the question because it looks like the Mayor violated the State’s Statute and the <br />Rules of Council #8 and #37 which were completed in January. <br /> <br />Mr. Price stated this was a perpetual pattern if certain people do certain things it was <br />justified. If other people do things that did not happen, regardless of facts, they were <br />unjustified. Mr. Price repeatedly asked Mayor Welsch what was her intent when she made <br />the information public, knowing the Council did not discuss releasing it for public purposes. <br />Mr. Price stated Council had a right to disagree with releasing the confidential material but <br />that never took place. He said he wanted to know from Mayor Welsch because she used <br />the same rules to go after others, but no rules applied to her. Mr. Price again asked Mayor <br />Welsch of her intent. He stated the Mayor implied that someone did something wrong <br />based on an opinion which he unequivocally disagreed with. <br /> <br />Mr. Kraft stated Point of Personal Privilege because he was feeling sick and asked to be <br />excused. <br /> <br />Mr. Price said he was sick also because his sinuses were bad. He said Mr. Kraft was not at <br />the last meeting and tends to step out whenever the City’s schools are mentioned. <br /> <br />Mayor Welsch stated that she would be glad to talk with Mr. Price in another forum and tell <br />him how she came to her decision. She stated that she would not get into that discussion <br />at the moment. <br /> <br />Mr. Price was adamant in getting a response from Mayor Welsch stating that he felt the <br />public needed to know. <br /> <br />Mayor Welsch reiterated that she would not discuss it at this time, but would be more than <br />willing to discuss it in another forum later. <br /> <br />7 <br /> <br /> <br />
