<br /> <br />Board of Adjustment <br />November 20, 2012 Meeting Minutes <br />(approved 12/18/2012) <br /> <br />A Board of Adjustment meeting was held on Tuesday November 20, 2012 in the Heman Park <br />Community Center, 975 Pennsylvania Avenue, University City, Missouri 63130. The meeting <br />commenced at 6:30 pm. <br /> <br />Members Present Members Absent <br />John Solodar, Chairperson Deborah Arbogast <br />Mike Krivonak Fannye Houston <br />Peggy Holly <br />Kathy Straatmann <br />Roger McFarland <br /> <br />Charles Marentette (attended as an alternate, but did not vote) <br /> <br />Staff Present <br />Ray Lai, Deputy Director of Economic and Community Development <br />Zach Greatens, Planner <br /> <br />1. Approval of Minutes <br />The minutes from the August 15, 2012 Board of Adjustment meeting were approved. <br /> <br />2. Case # 12-10758 8828 Washington Avenue <br />Robert Heyder (property owner) requested a variance to construct an attached deck maintaining a <br />side yard setback of 0.5 feet in lieu of 5 feet as required by Section 34-30.5.2.a(2) of the Zoning <br />Code for the residential lot in the SR Single Family Residential District. The variance was <br />deemed denied by a vote of 2 (opposed) to 3 (in favor), short of a concurring vote of four <br />members as required for approval of a variance. The Board members who voted in opposition <br />noted that based on the evidence presented the existence of a hardship was not evident and that <br />the 2.5 feet of clearance on the northwest corner of the house provided enough room to access <br />the back yard and that the proposed structure would create an unnecessary hardship by limiting <br />access to the back yard from the south side of the house. <br /> <br /> <br />tm; <br /> E <br /> <br />
