<br /> <br />Board of Adjustment <br />January 29, 2013 Meeting Minutes <br />(approved 2/20/2013) <br /> <br />A Board of Adjustment meeting was held on Tuesday January 29, 2013 at the Heman Park <br />Community Center located at 975 Pennsylvania Avenue, University City, Missouri. Approval of Minutes <br />The minutes from the December 18, 2012 Board of Adjustment meeting were approved. <br /> <br />2. Case # 13-00201 7300 Dartmouth Avenue <br />Jeffrey and Susan Hamer with J.A.C.K.S. Enterprises, Inc., requested a variance to provide zero <br />off-street parking spaces in lieu of the 26 spaces required by Section 34-94.2 of the Zoning Code <br />to serve a proposed restaurant. The variance was denied by a vote of 4 (opposed) to 1 (in favor). <br />The Board members who voted in opposition noted that the request, if approved, had potential <br />for adverse impact on the surrounding neighborhood as was stated by neighbors who spoke at the <br />meeting. <br /> <br />Three members of the public addressed the Board of Adjustment: <br /> <br />Randy McGee, property owner 7283 Dartmouth Avenue. Mr. McGee stated that he had <br />concerns about a new commercial tenant and potential for negative impacts on the neighborhood <br />and had specific concerns about lighting, trash, deliveries, and hours of operation. [An email <br />from Mr. McGee to City Council addressing his concerns was forwarded to the Board of <br />Adjustment members prior to the meeting and is on file.] <br /> <br />Alvan Sage of 523 West Drive in University City, representing Christ the King Church (7316 <br />Balson Avenue) and School (7305 Dartmouth Avenue). [Mr. Sage distributed a letter from <br />Christ the King Church. The letter is on file.] Mr. Sage stated that the position of the church <br />and school was that the proposed tenant would cause harm to the church. He stated that Christ <br />the King is an active parish with mass on Sunday and Saturday and evening activities during the <br />week in which parishioners use on-street parking. He stated that they were concerned about <br />parishioner safety and patrons of the proposed tenant using the church parking lot. <br /> <br />tm; <br /> šE <br /> <br />
