<br />expensed in the General Fund and not in the Reserves and that would bring the City to <br />a Fiscal Year deficit. Ms. Carr stated that with the proposed $235,000 from the <br />reserves, the City is running a deficit of $97,800 which is before the funding of the <br />Capital Improvement Plan. She said looking at one of the line items, the consulting <br />services for the Annex Building Interior use would be for moving the City forward in <br />trying to decide how the City will upgrade the police department building and this <br />expense could be removed as that expense would be moving toward an investment, <br />which would bring the deficit down to $37,800, just in the operating fund. Ms. Carr <br />noted in looking at the total revenues which the City has taken from the reserves: <br />2010 - $169,000; 2011 – $550,000; 2012 - $539,000 and this current year $1.5 million <br />and next year - $3.8 million. She noted that the City is continually taking money out of <br />the Reserve Fund and asked if it was justified and needed. Ms. Carr said in some <br />cases it was and thought it was dishonest to say the City is running a surplus when it <br />does not appear to be a surplus. She said it may be worthwhile projects to fund and <br />the City should admit that is what is being done; spending more than what is brought <br />in. <br /> <br />Mayor Welsch asked the City Manager to call the City Attorney Ms. Forster to the <br />podium again. Mayor Welsch asked Ms Forster in regard to the Sutter Meyer lease to <br />read the final segment of the lease which states that the City does have the authority if <br />it so chooses to work on the facility. <br /> <br />Ms. Forster quoted from the lease, paragraph 11, page five, titled Maintenance and <br />Care, “Lessee shall maintain or repair all portions of the premises including the <br />structural elements of the premises and shall replace portions of the premises that is <br />necessary from time to time to keep the premises in good and safe condition and in <br />compliance in requirements of this lease”. She noted that pursuant to paragraph 11, <br />the lease states “In the event that the Lessee or the society fails to maintain, repair <br />and or replace any portion of the premises as provided for herein in this lease, the <br />lessor (the City) shall have the right but not the obligation to perform such <br />maintenance, repairs or replacement as are required of the lessee or the society in <br />which even the lessee or the society shall reimburse the lessor or the City for its costs <br />in providing such maintenance, repairs or replacements together with a 5% charge for <br />the lessors or the City’s overhead and the lessee or the society shall promptly <br />reimburse the lessor, the City, for the amount so billed to the society by the City”. <br /> <br />Mayor Welsch asked to clarify, if the City put the painting of Sutter Meyer house in the <br />budget and if Mr. Walker in the future decided to use the funds to paint Sutter Meyer <br />farmhouse, this would not be violating the lease that was just read. <br /> <br />Ms. Forster stated no, so long as the City Manager makes an attempt to recoup the <br />funds that were expended by the City. <br /> <br />CITIZEN COMMENETS <br />Stefany Brot, 8145 Cornell Ct <br />Ms. Brot spoke as one of the founding members of the Sutter Meyer Society. She <br />provided a brief background on the formation of the Sutter Meyer Society. Ms. Brot <br />noted that the Sutter Meyer house is on the Historic National Register of Historic <br />places since 1982, and was also designated a University City landmark in 1986.
