January 22, 2007 <br /> <br />Ms. Ricci asked if there had been an evaluation of the fiber system that was in <br />place for the City. Mr. Martin said that the system is four or five years old and the <br />only City maintenance would be equipment used in connection with the cable as <br />hard drives, servers, etc. She asked if he thought the Council should be <br />concerned with the maintenance of the cable: Mr. Martin replied, no. Instead, he <br />suggested this section was just a protection for Charter. Ms. Ricci asked the <br />meaning of section 5.2 of the contract which stated what was meant by once every <br />12 months, the rates would be reviewed. Mr. Martin said that it meant the cost of <br />living increase could be applied to the maintenance fee: although, that paragraph <br />is truly unnecessary, Charter would not eliminate it. Ms. Ricci asked the City <br />Manager if hooking up the Fire House 2 needed to be addressed now. Ms. Feier <br />said it is dependent on the passage of this agreement. Right now, it is connected <br />with a separate temporary service due to the renovation there. <br /> <br /> <br />UNFINISHED BUSINESS <br />BILL 8921 <br />1. — AN ORDINANCE OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, APPROVING A MASTER FIBER AGREEMENT WITH CHARTER <br />COMMUNICATIONS. <br />Bill 8921 had its second and third reading. <br /> <br />Mr. Wagner said that he was still concerned about the maintenance agreement <br />with Charter as he felt it did not use strong enough language. <br />Mr. Price moved to approve bill 8921 and the motion was seconded by Mr. <br />Glickert. <br /> <br />Roll Call vote was as follows: <br /> AYES: Mr. Price, Ms. Ricci, Ms. Brot, Mr. Glickert, Mr. Sharpe, Jr., and Mayor <br />Adams <br />NAYS: Mr. Wagner <br /> <br /> Bill 8921 passed and was given Ordinance No. 6679. <br /> <br /> <br />BILL 8922 <br />2. — AN ORDINANCE AMENDING CHAPTER 8.24 OF THE <br />UNIVERSITY CITY MUNICIPAL CODE, RELATING TO NUISANCES,BY <br />ENACTING THEREIN A NEW SECTION TO BE KNOWN AS “SECTION <br />8.24.280 PLACES USED FOR THE UNLAWFUL POSSESSION OR <br />CONSUMPTION OF ALCOHOLIC BEVERAGES BY MINORS-SOCIAL <br />PARTIES;” CONTAINING A SAVINGS CLAUSE AND PROVIDING A PENALTY. <br /> <br />Bill 8922 was given its second reading. <br /> <br />Ms. Brot asked Mr. Mulligan, the city attorney, if it is against the law to serve <br />minors in your house now, why would we need this law? Mr. Mulligan <br />responded that this bill creates responsibility for the owner of the property to <br />insure that their property would not used by minors for alcoholic consumption.
