All filings shall be made using forms prescribed by the FCC7 or (if none <br />is proscribed in the fedoral rules) the local govornment, where applicable. As <br />described in Article 1II, Section 4. b., if no form is prescribed, the franchisee <br />shall state in its potition the rates it proposes to charge, and shall includo <br />the justification For the proposed schedule. The petition shall explain in full <br />how the Franchisee derived that rate, provido supporting documentation where it <br />proposes to base that rate on costs, and snow that the rate is reasonable under <br />the circumstances. <br /> <br />4. Under FCC rules, filings shall not be deemed to be complete unless all <br />attachments and supplemental exqlanations required by the forms are submitted <br />with the forms, and the Franchisee may be Found in violation of the Franchise or <br />in default of all applicable federal, state and local laws and rules. If the <br />filing is incomplete or deficiont, the City will notify Franchisee of same in <br />writing, and after the deficiency is cured, shall proceed with the review. <br /> <br />5. All submissions must be Filed in triplicate, as required in the original <br />franchise Rate Change Procedures (4.b.). <br /> <br />6. One copy of the filing or submission shall remain on file with the City <br />Clerk and be open for public inspection7 as roquirod in Soction 4.b. <br /> <br />7. Writton comments from any interestod party may be submitted in writing or <br />any other acceptable form~ including momorandums of verbal comments from <br />subscribors receivod by City employees. <br /> <br />8. Once initial regulated rates have been set~ a reduction in the number of <br />services provided on any sotvice tier, or a reduction in customer services shall <br />be considorod an incroase in ratos. <br /> <br />II. Initial Rate Filings (Form 393) <br /> <br />e. A franchisee who is notified that its basic cable and equipment taros are <br />subject to initial local rogulation must prove that its ratos For basic servico <br />and equipment are reasonable by submitting an appropriate filing. <br /> <br />10. Under FCC rules, initial rato filings (Form3e3 and attachmonts) must be <br />dolivored to the City Council or designatod City individual ~or review within 30 <br />days of the franchisee receiving notification that the City is certifiod to <br />regulate rates and has adoptod local rules. <br /> <br />11. The City Manager or his designee will review all information submitted and <br />may require the franchisee to submit such additional information as is necessary <br />to verify the accuracy of the filing and the roasonableness of the rates, <br />consistent with FCC regulations. <br /> <br />12. The City shall mako available For public inspection by interested partlos <br />a copy of the filing in the City Clerk's Office, as stated in Section 4.b. <br /> <br />33. Under FCC rules the City is required to issue an initial rate order within <br />30 days after receiving a complete and accurate filing from, the franchisee. <br /> <br /> <br />
