Session 1772 <br />January 10, 2000 <br /> <br />Mr. Wagner said it was important to find out how this area would be maintained if the City <br />vacates it. <br /> <br />Mr. Schoomer suggested proceeding with the introduction of the legislation since the public <br />hearing had already been published, but invite the appropriate residents to the next <br />meeting to discuss it further before we act on the bill. <br /> <br />Mr. Wagner asked the City Manager for clarification on his earlier question about the <br />maintenance of this property. Mr. Ollendofff said that this property is maintained the same. <br />Adjacent property owners are responsible for keeping it clean whether or not it is their <br />property or not. Mr. Wagner said that we need to maintain it in a safe condition, Mr. <br />Ollendorff stated that if this property is not vacated then the City would be responsible for <br />repairing any broken slabs or other problems. Mr. Wagner is concerned that if no one <br />claims it, then it could become dangerous. Mayor Adams said that this is the reason why <br />we will just introduce the bill tonight but we will withhold disposition until the residents on <br />both sides have been heard from. Mr. Lieberman stated that an additional problem is that <br />one half is vacated and the other is not. <br /> <br />AGENDA #3 - 500-546 NORTH & SOUTH CONDITIONAL USE PLAN AMENDMENT: <br /> <br />The City staff review of construction plans for this development revealed that the applicant <br />planned to increase the size of the 4th floor of buildings i & 2 by 30%. Such a substantial <br />change requires approval by the City Council under the terms of the conditional use permit. <br />The applicant has revised the plan to reduce the area of this addition, reduce the height of <br />one section of the addition, increase the patio setback from the east wall and slightly <br />reduce the overall height of the first building. The applicant has successfully demonstrated <br />that the modified plan revision results in very little change in the visibility of the 4th floor <br />from the neighboring properties to the east. <br /> <br />Approval of the revised amended plan is recommended since the applicant is correct in <br />demonstrating that the intent of the conditions adopted by the City Council would still be <br />met. The 4th floor of buildings I & 2 would be substantially hidden from view of N. Central <br />Ave. residents. <br /> <br />Mr. Mike Hill, 507 N. Central, questioned whether this should not necessitate a public <br />hearing, since it is an amendment. Mr. Ollendorff indicated that it does not require a public <br />hearing. Mr. Hill believes the neighborhood has been through enough already with this <br />project and feels this amendment should not be allowed. <br /> <br />4 <br /> <br /> <br />
