<br />noted that on June 27, 2011, it was voted on in Rule #24, which added that any two people <br />could put something on the agenda which was ordinance and resolutions. He noted in <br />November 2012, it was still a Council rule. Mr. Kraft stated that clearly the rules from 2006 did <br />not work anymore with the Sunshine Law compliance, and were missing stuff. Everyone agreed <br />at that time, the appointment process for boards and commissions was dysfunctional. <br /> <br />Mr. Price said a simple solution would be to add any two Councilmembers and being honest as <br />long as he is here, if this was deleted, he will not follow the rules. He stated they can concoct <br />some silliness to censor him a second time. He said if somebody gets shot in the third ward <br />that will not go on a study session and it will come to the floor. Mr. Price said if there was a big <br />incident that took place and the people in that area feel like nothing is being done, there is <br />nobody that can tell him that he cannot bring something to the table. If so there is no need to be <br />elected to represent your individuals. Mr. Price said he is not signing off or voting on nothing <br />that tells him in writing that two Councilmembers can bring something to the floor to discuss. He <br />said he would not go on “We can do that”. He is hearing a couple of things. The Mayor brought <br />this forward and now she is against it. He said maybe she is against it because she cannot <br />control it or maybe she was against it because it did not work out as she thought it would work <br />out but it was apropos to bring it when she brought it. Now she is against it and is very suspect <br />to him. He wanted something in writing that any two Councilmembers can bring something to <br />the floor for discussion and the Mayor threw in the caveat of she did not think anyone would <br />vote. Mr. Price said if it is put into a motion, Council can vote. He said anything on the agenda, <br />Council can vote on. Mr. Price said he did lived long enough to know better, if someone is <br />going on a gentleman’s or women’s agreement but there is nothing in writing so people can <br />make up stuff about what was agreed to and what was not agreed to. He stated he needed to <br />physically see that and if it is in Council’s Comments, there should be a rule that sits in there <br />that an agenda item can be brought by any Councilmember with a second and Councilmembers <br />need to be notified what that information is before the meeting. Mr. Price said he did not know <br />what Council is trying to do with this rule. He asked the Mayor what she was trying to do. Mr. <br />Price said the Mayor is probably behind this in some kind of a way. <br /> <br />Mr. Kraft said he has not stated a position on this and was not sure if the Mayor stated a <br />position on this either. <br /> <br />Mr. Sharpe said he agreed if there was a shooting, a flood, or an incident that happened within <br />the City, Council will be able to discuss it and vote on it if a necessity arose for them to do so. <br />He said he saw no reason what-so-ever that if an incident occurred that Council could bring it <br />forth and deal with it at a Council meeting. Mr. Sharpe stated that he certainly would not be a <br />person who would promote something that keeps Council from dealing with something that is <br />important to the City and its constituents. <br /> <br />Mr. Crow said to Mr. Sharpe that the rule as it is written does change it and would call for all of <br />Council to amend the agenda to get any of these things taken care of and believed that the jest <br />of the rule change has far more implications than he is giving it credit for. He thanked the <br />citizens for coming to a Council study session. He stated he had enough respect for the citizens <br />in the room that they have an understanding for what Ms. Carr was referencing when she used <br />the phrase gag rule. He stated she made it very clear as to what the implications are with the <br />suggested rule change. Secondly, he stated that any Councilmember who talks about a <br />hyperbole, he thought it was a little bit of a weakness particularly when there has been at least <br />one Councilmember who talk frequently about members trying to impinge upon his free speech <br />rights so this is a little bit of hyperbole as well. Mr. Crow still did not understand what problem <br />Council was trying to address by changing the rules and applauded Mr. Price who said at the <br />end of the day if this rule gets change the solution needs to be that any two Councilmembers <br />can add something to the agenda for a Council meeting. <br /> <br />6 <br /> <br /> <br />
