<br />asked Mr. Walker if he had the ability to either increase or raise her salary. Mr. <br />Walker stated that he did not. Mr. Price asked if Joyce was in the hierarchy of Mr. <br />Walker’s span of control. Mr. Walker stated that she would not. <br /> Mr. Price asked Mr. Walker if you looked at it in a budgetary item would Joyce fall <br />under the legislative budget. Mr. Walker stated yes. Mr. Price asked who controlled <br />the legislative budget to which Mr. Walker stated the City Council. Mr. Price stated <br />that since it has now been made clear to him that only the City Council can authorize <br />approval for representation for the City Clerk. He asked who gave the authority to <br />represent Joyce. He stated he would like to poll his colleagues individually to <br />determine whether any member of Council had granted such approval. Mr. Price <br />asked Ms. Carr if she had talked to the City Manager to agree to grant such approval. <br />She replied that she did not. Mr. Price then asked Mr. Kraft if he had talked to the <br />City Manager to grant the authority. <br /> Mr. Price stated that Mr. Kraft refused to answer so it could be either yes or no. <br />Mr. Kraft asked do you beat your wife because that is the kind of question you just <br />asked. Mr. Kraft in response to Mr. Price’s question said he did not ask the City <br />Attorney to represent Joyce. Mr. Price stated that was all Mr. Kraft needed to say. <br />Mr. Kraft started to speak and Mayor Welsch asked him to let Mr. Price finish. Mr. <br />Price said that this man was rude and the Mayor needed to put him in check. He <br />asked the Mayor the same question and she responded “no.” He followed by asking <br />Mr. Crow, Mr. Glickert and Mr. Sharpe is they had given authority to approve <br />authorization to represent the City Clerk and they all replied no. <br /> Mr. Price then asked Ms. Forster who had granted her the authority to represent <br />Ms. Pumm. Ms. Forster stated that she had received the authority to enter on behalf <br />of the City from Mr. Walker. She stated that Joyce pursuant to the Charter and the <br />State Statutes is the election authority representative for the City of University City. <br />She stated that technically the city is the Defendant and you cannot serve an order on <br />a city, the City Clerk, who is acting in her official capacity for the City is the individual <br />upon whom the order has to be served but she is acting in her official capacity for the <br />city. <br /> Mr. Price said when the situation took place the City Attorney found it necessary <br />not to let the people know who Ms. Pumm reports to, what was taking place. Ms. <br />Forster stated she reported to Mr. Walker and Mr. Price said that was not the <br />question he asked, his question was she don’t report to Mr. Walker, she reports to us, <br />so Ms. Forster decided who to notify that this situation was taking place. Ms. Forster <br />stated that Council had been notified of the City Clerk’s decision not to certify Mr. <br />Hales. Mr. Price asked if that was before the fact, after the fact, in-between the fact. <br />Ms. Forster stated that while she is not certain of the exact date, her understanding is <br />that Council was provided with a copy of the letter at the same time that it went out to <br />Mr. Hales. Mr. Price said so she really did not know when that took place. <br /> Mr. Price stated that he finds it somewhat ironic because some things are déjá vu, <br />some things happen twice and it was ironic as he was making his bid for election in <br />2006 he had received a call from the Clerk informing him that his taxes had not been <br />paid. He stated that his son, whose name is not Byron R. Price, had not paid his <br />taxes, nor had his daughter’s taxes been paid, that is when they were all living with <br />him. However once it was determined that he had paid his taxes, he was then <br />informed that he was also required to pay his children’s taxes. Mr. Price said he then <br />had to say you can jump in the river, go talk to whoever you want to as he was not <br />responsible to pay anybody else’s taxes that reside in his household. He said then <br />he got a call saying he did not have to pay those. At the same time this was going on <br />7 <br /> <br /> <br />
