J <br /> Resolution - Page 6 <br />' (Iie <br /> PROPOSITION NO. 20 <br /> 4 <br /> i <br /> Shall the City of University City amend Article XI "Public t <br /> Improvements Generally" by adding a new section to be designated <br /> Section 101, so that any real estate, now or hereafter owned by <br /> the City or any agency or instrumentality of the City, which is . <br /> a) unimproved and greater than one acre in size or b) principally t <br /> used or held out for use as a public park or recreational facility, <br /> shall not be sold or otherwise disposed of, and shall remain <br /> unimproved or be used only as a public park or recreational <br /> facility, unless a sale, disposal or change in use is approved by <br /> four-sevenths (4/7ths) of the qualified electors voting thereon at <br /> an election called pursuant to an ordinance duly adopted by the <br /> Council. As used in this section the term "public park or <br /> recreational facility" includes, without limitation, nature study <br /> areas, gardens, playgrounds, golf courses, and all accommodating <br /> activities customarily associated with park usage or outdoor <br /> recreation? This amendment shall become effective on its adoption <br /> by a majority of the qualified electors voting thereon. <br /> AND WHEREAS, pursuant to Article IX, Section 71 of the City Charter, <br /> the election returns shall be canvassed by the City Council at a meeting <br /> not later than forty-eight (48) hours after their receipt by the City <br /> Clerk, and the candidates receiving the highest number of votes for each <br /> office be declared elected. <br /> NOW, THEREFORE, pursuant to the laws of the State of Missouri, the <br /> City Charter, and the Ordinances of the City of University City, and the <br /> rules and regulations promulgated by the Board of Election Commissioners of <br /> St. Louis County, the City Council of University City, at a meeting held <br /> April 16, 1990, at 7:30 P.M. , upon the certification of the returns by the <br /> Board of Election Commissioners of St. Louis County from the thirty-seven <br /> precincts in the City of University City, and upon certification by the City <br /> Clerk of the results of said election, held Tuesday, April 3, 1990, in the <br /> City of University City, and a canvass by the Council of said returns of <br /> C <br />
