All voted Aye except Mr. Wagner, who voted Nay. <br /> COmDITIONAL USE - PiZZA HUT. 7852 OLIVE <br /> The City Manager said an application for a conditional use permit was reviewed <br /> by the Plan Commission and approval recommended for a Pizza Hut carry-out res- <br /> taurant with delivery service at the new Westover Center, but with the follow- <br /> ing conditions: <br /> 1. Delivery service employees shall use the Mount Olive Avenue entrance/ <br /> exit when making and returning from deliveries. <br /> 2. The operator shall regularly police the site and area adjacent to the <br /> restaurant to remove litter generated by the business. <br /> Mayor Majerus noted the condition on a different facility in the same shopping <br /> center having to do with compliance with the Sign Code, and she asked if that <br /> should not be included here. Mr. 011endorff said it could be, however, this <br /> application already seemed to meet all Sign Code provisions. <br /> Mrs. Schuman asked about operating hairs, and Mr. Paul Hentzen, 322 Belmont, <br /> Wichita, ES, representing Pizza Hut, came forward. He said normal operating <br /> hours were 11 a.m. to 1 a.m. Mr. 011endorff noted that Council has restricted <br /> late hours for businesses that back up directly to a residential area, but the <br /> Center is not immediately adjacent to residences. <br /> Mr. Price was concerned about drivers leaving the premises at excessive speeds. <br /> Mr. Hentzen said Pizza Hut, unlike another pizza business, does not make a <br /> time guarantee on its deliveries, so there is no reason for drivers to speed. <br /> Mr. Wagner asked how important it was for the business to stay open to 1 a.m. <br /> Mr. Hentzen said the 1 a.m. closing was consistent with the other Pizza Hut <br /> stores, however, he did not know the percentage of sales after midnight. <br /> Mrs. Thompson asked about the hours for the other pizza delivery businesses in <br /> the City. Mr. 011endorff believed there may be restrictions on the ones that <br /> are in Limited Commercial Districts that back directly to residential areas. <br /> Mr. Hentzen said most of the business occurs between 6 p.m. and 8:30 p.m. ; af- <br /> ter that, only one driver is working, plus walk-in traffic which is usually <br /> light. He said he did not object to a condition limiting the closing hair to <br /> 1 a.m. Mr. 011endorff said that condition would be added, as well as compli- <br /> ance with the Sign Code. <br /> (re Mr. Price moved approval with all conditions.
