Session 1787 <br />June 19, 2000 <br /> <br />firefighters solicited funds for burn victims in front of Value City and Schnucks and made <br />$1200. <br /> <br />Mr. Lieberman moved denial. The motion died for lack of a second. <br /> <br />Mr. Schoomer stated that the Circuit Court of Missouri has ruled that this is a permitted <br />activity under the first amendment of the Constitution. <br /> <br />Mr. Schoomer moved approval. Mr. Sharpe seconded the motion. <br /> <br />Mr. Munkel leans toward agreeing with Mr. Lieberman, but understands what Mr. <br />Schoomer has stated about it being allowed. He wonder why it even has to come before <br />Council. <br /> <br />Mr. Schoomer says that we do limit. We require registration of those soliciting and we limit <br />the hours of operation which are agreed to and permitted by the courts. <br /> <br />Responding to Mr. Sharpe, Mr. Rose stated that there have been no problems with this <br />group. <br /> <br />Mr. Lieberman stated that the Zoning Code does provide controls for private property, <br />which this is one of them. <br /> <br />Sharon Smith, 4366 Maryland #105, responding to Mr. Lieberman, stated that MoPIRG <br />has used the same successful approach for ten years to build up its 10,000 + member <br />base. One of the reasons they go back to the same communities is because they have <br />members in each one that they ask to renew their memberships. <br /> <br />Mr. Lieberman asked why they could not at least try to do this in front of the businesses. <br />Ms. Smith said that she could answer his question specifically, but this is the way they <br />operated since the beginning and how they operate now in 33 states. <br /> <br />The Mayor called the question. All voted Aye, except for Mr. Lieberman who voted Nay. <br />The motion passed 6 to 1. <br /> <br />QUESTION ON CONSENT CALENDAR ITEM #1 - <br /> <br />Responding to Mr. Lieberman, Mr. Rose stated that the vendor awarded the gasoline and <br />diesel contract can raise their prices, but that it cannot exceed 10%.
