SOULE <br /> <br /> ORDIltANCENO. <br /> <br />AN ORDINANCE ANENDIN~ CtlAPTER 4, !eNICIPAL CODE OF THE CITY <br />OF UNIVERSITY CITY, REIATING TO ALCOHOLIC BEVERAGES BY <br />PEALING SECTION 4-45, REI~TXNG TO THE HOURS OF SALE AND EN- <br />ACTING THEREIN A NEW SECTION TO BE KNOWN AS "SECTION 4-45, <br />HOURS OF SALE; SALE ON SUNDAY AND ELECTION DAT'; AND ADDING <br />A PROHIBITION ON A SALE BY ANY AGENT OR EMPLOYEE OF A LICEN- <br />SEE; CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY TH~ COUNCIL OF THE CITY OF ~ITY CITY, MISSOURI, <br />AS FO~: <br /> <br /> Section 1. Chapter 4 of the Municipal Code of the City of University <br />City, Missouri, relating to alcoholic beverages is hereby amended by repealing <br />Sectiox% 4-~5 thereof, relatin8 to hours of sale and sale on Sunday and election <br />day and enacting in lieu thereof a'new section to be known as Section 4-45, re- <br />lattn~ to the same subject, and reenactin8 said section and including therein a <br />prohibition aSainst any agent or ~loyee of any such licenses violatin8 said <br /> <br />section so that said new section, as so amended, shall read as follows| <br /> <br />Section 4-45. House of sale: sale on Sunday and election day: <br />It shall be unlawful for any licensee or any agent or employee of such <br />licenses under this article to seI1, 8ire away, or otherwise dispose <br />ofs or suffer the same to be done, upon or about his premises, any non- <br />intoxicating beer in any quantity between the hours of 1:30 A.M. and <br />6:00 A.M., nor shall any such person sell, give away, or otherwise dis- <br />pose of, or suffer the same to be done, upon or about said premises, <br />any nonintoxicating beer in any quantity whatever between th2Jl~Brs of <br />1:30 A.M. and 1:00 P.M. on the first day of the week commonly called" <br />Sunday, or upon the day of any Seneral, special or primary electien, <br />whether national, state, county or municipal, held in the city after <br />1:30 A.M. on such day; provided, that the sale of such nenintoxicatinS <br />beer may be resumed on any such election day a~ter the expiration of <br />thirty minutes next followinS the hour or time fixed by law for the <br />closing of the polls at any such election. <br /> <br />Section 2. This ordinance shall not be construed so as to relieve any <br /> <br />person, finn or corporation from any penalty heretofore incurred by the violation <br /> <br />of Section 4-.45, nor bar the prosecution of any such vielation. <br /> <br />Section 3. Any person, finn or corporationviolatinS this ordinance <br /> <br />shall, upon conviction thereof, be subject to the penalty provided in Chapter 1, <br /> <br />Section 1-8 of the Municipal Code of the City of University City. <br /> <br />Section 4.
