(d) In the event the Commission shall have entered a cease and desist order, the Commission shall, in cases of noncompliance therewith, certify the entire case to the City Counselor for appropriate action. No prosecution shall be brought under this ordinance except upon such certification, provided~ however, that in cases dismissed by failure of the Commission to act as provided in Section Five (5) (b), or if the Commission dismisses a complaint, the complainant may present such complaint directly to the City Counselor for such action as he shall deem advisable. (e) Ail complaints, answers, investigations, conferences and hearings held under and pursuant to this ordinance shall be held confidential by the Com- mission and their agents and employees~ provided, however, that the Commission may, at the request of the complainant, or on its o%m initiative, and shall, at the request of the respondent, declare the hearing provided for under Section Five (5) (c) of this ordinance to be an open and public hearing. Section 6. Any persons violating any of the provisions of this ordinance shall be guilty of a misdemeanor and shall be fined not less than $25.00 nor more than $500.00. Section 7. If any of the provisions of this ordinance or portions thereof or the application of such provisions or portions to any person or cir- cumstances shall be held invalid, the remainder of this ordinance and its appli- cation to persons or circumstances other than those to which it is held invalid shall not be affected thereby. Section 8. A copy of this ordinance shall be mailed to all places of public accommodation as herein defined and possessing any license from the City of University City including such license for the conduct of business. ~ection 9.
