(d) In the event the Commission shall have entered a cease and desist <br />order, the Commission shall, in cases of noncompliance therewith, certify <br />the entire case to the City Counselor for appropriate action. No prosecution <br />shall be brought under this ordinance except upon such certification, provided~ <br />however, that in cases dismissed by failure of the Commission to act as <br />provided in Section Five (5) (b), or if the Commission dismisses a complaint, <br />the complainant may present such complaint directly to the City Counselor <br />for such action as he shall deem advisable. <br /> <br />(e) Ail complaints, answers, investigations, conferences and hearings held <br />under and pursuant to this ordinance shall be held confidential by the Com- <br />mission and their agents and employees~ provided, however, that the Commission <br />may, at the request of the complainant, or on its o%m initiative, and shall, <br />at the request of the respondent, declare the hearing provided for under <br />Section Five (5) (c) of this ordinance to be an open and public hearing. <br /> <br /> Section 6. Any persons violating any of the provisions of this ordinance <br />shall be guilty of a misdemeanor and shall be fined not less than $25.00 nor more <br /> <br />than $500.00. <br /> <br /> Section 7. If any of the provisions of this ordinance or portions <br />thereof or the application of such provisions or portions to any person or cir- <br />cumstances shall be held invalid, the remainder of this ordinance and its appli- <br />cation to persons or circumstances other than those to which it is held invalid <br /> <br />shall not be affected thereby. <br /> <br /> Section 8. A copy of this ordinance shall be mailed to all places of <br />public accommodation as herein defined and possessing any license from the City <br />of University City including such license for the conduct of business. <br /> <br /> ~ection 9.
