INTRODUCED BY COUNCILMAN METCALFE <br />BILL r'0. 7340 _ ORDINANNCE NO. 5172 <br />AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE <br />CITY OF UNIVERSITY CITY RELATING TO ZONING BY REPEALING <br />SECTION 34 -51.4 THEREOF, RELATING TO PERMITTED HOME <br />OCCUPATION, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE <br />KNOWN AS "SECTION 34 -51.4. PERMITTED HOME OCCUPATION ", BY <br />AMENDING SAID SECTION SO AS TO ADD SUB - SECTION (H) FAMILY DAY <br />CARE HOME; CONTAINING A SAVING CLAUSE AND PROVIDING A <br />PENALTY. <br />WHEREAS, Chapter 34 of the the Municipal Code of the City of <br />University City (University City Zoning Code) divides the City into several <br />zoning districts, and regulates the uses to which the premises located therein <br />may be put; and <br />WHEREAS, Section -34 -51.x+ provides for Permitted Home Occupation; and <br />WHEREAS; the City Plan Commission, after a hearing, reviewed said <br />section; and <br />WHEREAS, due <br />notice <br />of <br />a public <br />hearing <br />to be <br />held <br />by the City <br />Council in the Council <br />Chamber <br />at <br />City Hall, <br />at 8:00 <br />P.M. <br />on the <br />21st day of <br />May, 1979, was given; and <br />WHEREAS, said public hearing was duly held at the time and place <br />specified in said notice, and all suggestions or objections concerning said <br />change in said section were duly heard and considered by the Council. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br />Section 1. Chapter 34 of the Municipal Code of the City of <br />University City, Missouri, relating to Zoning is hereby amended by repealing <br />Section 51.4 thereof, relating to Permitted Home Occupation, and enacting in <br />lieu thereof a new section to be known as "Section 34 -51.4. Permitted Home <br />Occupation ", by adding sub - section (h) family day care home relating to the <br />same subject, and re- enacting said section so that said section, as so amended, <br />shall read as follows: <br />34 -51.4. Permitted Home Occupation <br />Customary home occupations include, but are not limited to, <br />the following list of occupations, provided, however, that <br />each listed occupation shall be subject to the limitations <br />of Section 34 -39.7: <br />a. Dressma kers, seamstresses, tailors. <br />
