BILL NO. 7341 <br />INTRODUCED BY COUNCILMAN METCALFE ' <br />ORDINANCE NO. 5173 <br />AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE <br />CITY OF UNIVERSITY CITY RELATING TO ZONING BY REPEALING <br />SECTION 34 -90 RELATING TO DEFINITIONS, AND ENACTING THEREIN A <br />NEW SECTION TO BE KNOWN AS "SECTION 34 -90 DEFINITIONS" BY <br />AMENDING SAID SECTION SO AS TO SUBSTITUTE THE DEFINITION OF <br />CHILD DAY CARE TO CHILD DAY CARE CENTER, NURSERY SCHOOL, OR <br />DAY NURSERY, AND CHANGE THE DEFINITION OF FAMILY DAY CARE <br />HOME; CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. <br />WHEREAS, Chapter 34 of the the Municipal Code of the City of <br />University City (University City Zoning Code) divides the City into several <br />zoning districts, and regulates the uses to which the premises located therein <br />may be put; and <br />WHEREAS, Section 34 -90 thereof provides for Definitions; and <br />WHEREAS, the City Plan Commission, after a hearing, reviewed said <br />section; and <br />WHEREAS, due notice of a public hearing to be held by the City <br />Council in the Council Chamber at City Hall, at 8:00 P.M. on the 21st day of <br />May, 1979, was made; and <br />WHEREAS, said public hearing was duly held at the time and place <br />specified in said notice, and all suggestions or objections concerning said <br />change in said section were duly heard and considered by the Council. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br />Section 1. Chapter 34 of the Municipal Code of the City of <br />University City, Missouri, as comprehensively amended August 2, 1966, by <br />Ordinance No. 4988, is hereby amended by repealing Section 34 -90 thereof, <br />relating to definitions, and enacting in lieu thereof a new section by amending <br />Section 34 -90, Definitions, so as to substitute the definition of child day <br />care to child day care center, nursery school, or day nursery, and change the <br />definition of family day care home, so that said section, as so amended, shall <br />read as follows: <br />ARTICLE VII - DEFINITIONS <br />Section 34 -90 <br />Accessory use (Structure) - -see Section 34 -52.2 <br />Alley - -CF Public Service Drive. <br />©1 <br />. <br />�E <br />
