INTRODUCED BY COUNCILMEMBER METCALFE BILL NO. 7454 ORDINANCE NO. 5258 AN ORDINANCE AMENDING CHAPTER 18 OF THE MUNICIPAL CODE OF THE CITY OF UNIVERSITY CITY, RELATING TO LICENSES AND BUSINESS REGULATIONS, BY REPEALING SECTION 18-56 THEREOF, AS AMENDED BY ORDINANCE N0. 4892, ENACTED DECEMBER 16, 1974, RELATING TO LICENSE APPLICATIONS, STATEMENTS AND FEES FOR MERCHANTS, AND ENACTING IN LiEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 18-56. LICENSE--APPLICATION AND STATEMENT; LICENSE FEE GENER- ALLY," BY AMENDING SAID SECTION SO AS TO INCREASE THE RATE OF TAX FROM ONE DOLLAR ($1.00) TO ONE DOLLAR AND SIXTEEN CENTS ($1.16); CONTAINING A SAVING CLAUSE, PROVIDING A PENALTY, AND CONTAINING AN EMERGENCY CLAUSE. • BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Chapter 18 of the Municipal Code of the City of University City, relating to Licenses and Business Regulations, is hereby amended by repealing Section 18-56 thereof, as amended by Ordinance No. 4892, enacted December 16, 1974, relating to license applications, statements and fees for merchants, and enacting in Iieu thereof a new section to be known as "Section 18-56. License-Application and statement; license fee generally," by amending said section so as to increase the rate of tax from One Dollar ($1.00) to One Dollar and Sixteen Cents ($1.16), relating to the same subject, and re-enacting said section so that said section, as so amended, shall read as follows: Sec. 18-56. License--Application and statement; license fee generally All persons desiring to engage in the business of a merchant shall file with the Director of Finance on or before the last day of April of each calendar year an application for a license on such forms as may be presecribed by him. Such application shall be accompanied by a statement showing the amount of gross receipts during the preceding calendar year together with tax computed at the rate of One Dollar and Sixteen Cents ($1.16) on each One Thousand Dollars ($1,000.00) or part thereof in value of annual gross receipts for the preceding calendar year; pro- vided, however, that the minimum license fee shall be the sum of Thirty Dollars ($30.00) per year or any part thereof. Section 2. This ordinance shall not be construed so as to relieve any person, firm or corporation from any penalty heretofore incurred by the violation of Section 18-56 nor bar the prosecution for any such violation. Section 3. Any person, firm or corporation violating any of the pro- visions of this ordinance, shall, upon conviction thereof, be subject to the penalty provided in Chapter 1, Section 1-8 of the Municipal Code of the City of University City.
