2. Company's Liability: Each occurrence One Hundred Thousand <br /> Dollars ($100,000); aggregate Eight Hundred Thousand Dollars <br /> ($800,000). <br /> <br /> 3. Comprehensive General Liability: Bodily injury, each <br /> person Three Hundred Thousand Dollars ($300,000) and each <br /> occurrence One Million Dollars ($1,000,000); property damage, <br /> each accident One Hundred Thousand Dollars ($100,000) and <br /> aggregate Eight Hundred Thousand Dollars ($800,000). <br /> <br /> 4. Comprehensive.Automobile Liability: Including non-owner- <br /> ship and hired car coverage as well as owned vehicles with <br /> minimum limits as follows: Bodily it]jury for each person <br /> Three Hundred Thousand Dollars ($300,000) and each occurrence <br /> One Million Dollars ($1,000,000); property damage for each oc- <br /> currence Eight Hundred Thousand Dollars ($800,000). <br /> <br /> b) The insurance policies obtained by the Company in compliance with <br />this section must be approved by the City Attorney and such insurance policies, <br />along with written evidence of payment of required premiums, shall be filed and <br />maintained with the City Manager during the term of the franchise, and may be <br />changed from time to time to reflect changing liability limits. The Company <br />shall immediately advise the City Attorney of any .litigation that may develop <br />that would affect this insurance. <br /> <br /> c) Neither the provisions of this section nor any damages recovered by <br />the City thereunder, shall be construed as to limit the liability of the Com- <br />pany under any franchise issued hereunder or for damages. <br /> <br /> d) All insurance policies maintained pursuant to this franchise shall <br />name the City co-insured and contain the following endorsement: <br /> <br /> "It is hereby understood and agreed that this insurance <br /> policy may not be cancelled by the surety nor the inten- <br /> tion not to renew be stated by the surety until thirty <br /> (30) days after receipt by the City, by registered <br /> mail~ of a written notice of such intention to cancel or <br /> not to renew." <br /> <br />Section 16. Indemnification <br /> <br /> a) The Company shall, at its sole cost and expense, fully indemnify, <br />defend and hold harmless the City, its Officers, Boards, Commissions and em- <br />ployees against any and all claims, suits, actions, liability and judgments for <br />damages (including but not limited to expenses for reasonable legal fees and <br />disbursements and liabilities assumed by the City in connection therewith): <br /> <br />1. Arising in any way to persons or property out of or <br />through the acts or omissions of the Company, its ser- <br />vants, agents or employees, or to which the Company's <br />negligence shall be the approximate cause; <br /> <br />14 <br /> <br /> <br />
