n) "Educational Channel" means any channel where the educational <br />institutions are the only designated programmers. <br /> <br /> o) "Fair market value" means the price that a willing buyer would <br />pay to a willing seller for a going concern. <br /> <br /> p) "FCC" shall mean the Federal Communications Commission and any <br />legally appointed or elected successor exercising regulatory authority over <br />Cable Television. <br /> <br /> q) "Franchise" shall mean the nonexclusive rights granted pursuant <br />to this ordinance to construct and operate a Cable Television System along the <br />public ways within the City. Any such authorization, in whatever form granted, <br />shall not mean to include any license or permit required for the privilege of <br />transacting and carrying on a business within the City as required by other <br />ordinances and laws of this City. Provisions of the franchise impose duties <br />and obligations on any person operating the system as a successor, trustee, <br />assignee or receiver of the grantee and any person or corporation of which the <br />grantee is a majority owned subsidiary. <br /> <br /> r) "Full network service" shall mean all basic services offered by <br /> <br />the Company. <br /> <br /> s) "Government channel" means any channel where local government <br />agencies are the only designated programmers. <br /> <br /> t) "Gross revenues" shall mean all revenue derived directly or in- <br />directly by the Company, its affilfates, subsidiaries, parent, and any person <br />in which the Company has a financial interest, from providing cable television <br />services within the City, ~ncluding, but not limited to basic subscriber <br />service monthly fees, pay cable fees, additional service fees, instal]ation and <br />reconnection fees, leased channel fees, converter rentals, studio rental, pro- <br />duction equipment and personnel fees, and advertising revenues~ provided, <br />however, that this shall not include any taxes on services furnished by the <br />Company herein imposed directly upon any subscriber or user by the State, local <br />or other governmental unit and collected by the Company on behalf of said <br />governmental unit. <br /> <br /> <br />
